RECgI~ENDATION:
Conduct a public hearing to receive testimony from affected residents and
adopt Resolution No. 87-20 at the conclusion of the hearing.
BACKGROUND:
The Cortese-Knox Local Government Reorganization Act of 1985 authorizes the
City Council to make application for the annexation of territory after
publication of a notice of intention to adopt a resolution and conduct a
public hearing. Notice of hearing was published in the TUstin News on
February 5, 1987, and was noticed to all property owners within the
proposed annexation area known as Eveningside/Rainbow Annexation No. 139 to
the City of Tustin.
The proposed annexation area is bounded by Irvlne Boulevard on the south,
Browning Avenue on the west, La Colina on the north and the Irvine Ranch on
the east. Eighty five single-family homes and the Tustin Memorial
Elementary School are the existing land uses within the proposed annexation
area. Zoning for the entire area is E-4 (Estate Residential). According
to the Orange County Registrar's Office, there are 179 registered voters in
this area of which 34 signed a petition to annex into the City.
DISCUSSI0N:
The hearing before the City Council is an informational hearing to provide
an opportunity for the residents of the area to express their concerns and
views on the'resolution of application. This is not a protest hearing and
the filing of a protest at this hearing has no validity as to the status of
the annexation proposal.
FollOWing the hearing City Council has the discretion to table the
resolution of application or to adopt the resolution. If City Council
adopts Resolution No. 87-20, the Local Agency Formation Commission conducts
a fact finding hearing to determine if the subject proposal meets the
requirements of the Government Code.

Upon LAFO's determination, the n~tter is referred to the City Council as
the "conducting authority" for a protest hearing. In the case of inhabited
territory, if less than 25~ of the registered voters of the area file a
protest than the "conducting authority" orders the annexation without an
election. If 25[ to 50~ of the registered voters of the area file a
protest then the "conducting authority" must order an election. If more
than 50[ of the registered voters protest then the annexation would be
terminated.

County Recorder of said Orange County, California,

BEGINNING at an angle point in the existing boundary
line of the City of Tustin as established by the
"Ranchwood-Bellwick Annexation No. 138," said angle point
being the most northerly corner of said Annexation, and
also being the centerline intersection of Browning Avenue
and Irvine Boulevard, and said angle point also being the
most westerly corner of said Lot 339 in Biock 43 of
Irvine's Subdivision;

RESOLUTION NO. 87-20
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TUSTIN, CALIFORNIA, MAKING
APPLICATION FOR THE ANNEXATION OF
TERRITORY KNOWN AS EVENINGSIDE/RAINBOW
ANNEXATION NO. 139.
WHEREAS, the City Council of the city of Tustin on its own motion has
initiated preliminary proceedings for the annexation of certain inhabited
territory; and
WHEREAS, the city of Tustin has the ability to extend the full range
of municipal services to the subject te'rrttory to better serve the needs of
the residents of the area; and
WHEREAS, an advertised public hearing will be conducted by the City
Council on February 17, 1987 on the Council intent to adopt a resolution of
application for annexation of the subject territory to the city of Tustin;
and
WHEREAS, the City Council has determined that the proposed annexation
is a Categorical Class 19 exemption' from the requirements of CEQA;
NOW, THEREFORE BE IT RESOLVED, by the City Council of the city of
Tustin, California that:
1. The proposal for the Evenlngslde/Rainbow Annexation No. 139 to
the city of Tustin is made pursuant to Part 3, Chapter 1 of the
Cortese-Knox Local Government Reorganization Act of 1985.
2. The proposed change of organization consists of the annexation
of acres of inhabited island territory, surrounded by the
incorporated limits of the city of Tustin, and the County of
Orange, and said territory will derive benefits of full
municipal services as a result of the annexation.
The subject territory is bounded by Irvine Boulevard on the
south, Browning Avenue on the west, and the Irvine Ranch on the
east and La Colina on the north.
4. The proposed annexation is made for the purpose of increasing
the economy and efficiency of government services 6y
incorporating territory within the city's sphere of influence.
5. The application for annexation is submitted by the City Council
of the city of Tustin on its own motion along with a request
from various owners and voters in the area.

The Local Agency Formation Commission Is hereby requested to
bndertake annexation proceedings pursuant to Part 2, Chapter 3
of the Cortese-Knox Local Government Reorganization Act of 1985.
PASSED AND ADOPTED at a regular meeting of the City Council of the
city of Tustin, California on the day of , 1987.
