Motion carried 5-0. Adopted Resolution No. 03-92, as modified Approved TENTATIVE PARCEL MAP 2003-131 Mayor Wodey opened the public hearing at 7:05 p.m. The following member of the audience spoke in support of Tentative Parcel Map 2003-131: Ted Stelzner, 1208 N. Euclid Avenue, Ontario There were no other speakers and the public hearing was closed. It was moved by Thomas, seconded by Davert, to adopt the following Resolution No. 03-92, as modified: RESOLUTION NO. 03-92 - A RESOLUTION OF THE TUSTIN CITY COUNCIL, APPROVING TENTATIVE PARCEL MAP NO. 03-131 TO RESUBDIVIDE A 4.09 ACRE SITE LOCATED AT THE NORTHEAST CORNER OF EL CAMINO REAL AND SIXTH STREET INTO FOUR (4) NEW PARCELS FOR THE PURPOSE OF DEVELOPING A GARDEN CENTER ON A 1.47-ACRE PARCEL AT THE NORTHWEST OF THE PROPERTY FOR A GARDEN CENTER Motion carried 5-0. CONSENT CALENDAR (Agenda Items 3 through 9) It was moved by Davert, seconded by Thomas, to approve the Consent Calendar as recommended by staff. Motion carried 5-0. APPROVAL OF MINUTES - JULY 7, 2003 REGULAR MEETING Recommendation: Approve the City Council Minutes of July Minutes - City Council July 21,2003 - Page 2 7,2003. Approved APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $285.00; $9,566,557.97; and $1,074,138.03 respectively and ratify Payroll in the amount of $479,400.09. Ratified PLANNING COMMISSION ACTION AGENDA - JULY 14, 2003 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of July 14, 2003. Approved QUARTERLY INVESTMENT REPORT Recommendation: Receive and file the report. Adopted 03-93 Resolution No. APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZATION TO ADVERTISE FOR BIDS FOR THE JAMBOREE ROAD MEDIAN BARRIER INSTALLATION BETWEEN BARRANCA PARKWAY AND THE OCTA/SCRRA BRIDGE N/O EDINGER AVENUE (CIP NO. 7162) Recommendations: 1. Adopt resolution. RESOLUTION NO. 03-93 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE JAMBOREE ROAD MEDIAN BARRIER INSTALLATION BETWEEN BARRANCA PARKWAY AND THE OCTA/SCRRA BRIDGE N/O EDINGER AVENUE (CIP NO. 7162) AND AUTHORIZE ADVERTISEMENT FOR BIDS Authorizing and directing the City Clerk to advertise for bids subject to State of California, Department of Transportation (Caltrans) approval of the project. Minutes - City Council July 21, 2003 - Page 3 Adopted 03-94 Resolution No. ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE A NOTICE OF COMPLETION FOR THE RED HILL AVENUE AT SAN JUAN STREET TRAFFIC SIGNAL MODIFICATION/UPGRADE (CIP NO. 4062) Recommendations: 1. Adopt resolution. RESOLUTION NO. 03-94 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE RED HILL AVENUE AT SAN JUAN STREET TRAFFIC SIGNAL MODIFICATION / UPGRADE (CIP NO. 4062) 2. Direct the City Clerk to: * Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and * Release the Faithful Performance bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop payment notices are filed, it is further recommended that thirty-five (35) days after the date of recordation of the Notice of Completion the City Council authorize payment of the final 10% retention in the amount of $12,110.60 to KDC, Inc. dba Dynaelectric. This amount, together with previous contract payments and change order amounts of $108,995.35 represents 100% of the final contract cost. Approved AWARD OF BID - COMMUNITY CENTER ACOUSTICAL IMPROVEMENTS Recommendations: The City Council award the contract to Unique Performance Construction of Costa Mesa, California in the amount of $11,539 subject to the approval of contract requirements by the City Attorney and final execution. 2. The City Council reject the bid of Delta Contracting Minutes - City Council July 21, 2003 - Page 4 Corporation of Redlands, California, as being non- responsive. The fiscal impact of the above project will be financed through the 2002/2003 unappropriated Capital Projects Fund carried over to 2003/2004 fiscal year and assigned to the account of the Major Building Maintenance (account no. 1032). Adopted Ordinance No. 1278 10. REGULAR BUSINESS (Agenda Items 10 and 11) ADOPTION OF ORDINANCE NO. 1278 - ZONE CHANGE 03-004:2681 WALNUT AVENUE It was moved by Davert, seconded by Thomas, to have second reading by title only and adoption of Ordinance No. 1278. Pamela Stoker, City Clerk, read the following Ordinance No. 1278 by title only: ORDINANCE NO. 1278 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADDING SECTIONS V(I), SUBSECTION 14, AND SECTION VI(C), SUBSECTIONS 4 AND 5 TO THE IRVINE INDUSTRIAL COMPLEX PLANNED COMMUNITY DISTRICT REGULATIONS, ESTABLISHING OUTDOOR RECREATIONAL VEHICLE (RV) STORAGE AS A CONDITIONALLY PERMITTED USE, AND ESTABLISHING DEVELOPMENT STANDARDS AND A DEFINITION Motion carried 5-0 (roll call vote). Approved None 11. FEE WAIVER PERMIT FOR THE TUSTIN PUBLIC SCHOOLS FOUNDATION 2003 DINOSAUR DASH It was moved by Thomas, seconded by Davert, to grant a fee waiver of staff costs and equipment of $7,200 and issue a permit for the 2003 Dinosaur Dash. Motion carried 5-0. SECOND PUBLIC INPUT OTHER BUSINESS/COMMITTEE REPORTS - City Manager, City Attorney, City Council Minutes - City Council July 21, 2003 - Page 5 Councilmember Davert Councilmember Bone · Inquired if the senior center was available for seniors to use while the weather conditions were hot. · Announced Diamond Valley Lake was opening on September 1,2003; · Reported that the Metropolitan Water District was proposing rate increases beginning in 2004; · Reported Tustin water usage was down again this month; · Announced that Tustin Pride poster winners would be displayed in City Hall in the near future; · Reported on League of California Cities conference in Monterey, CA. Councilmember Thomas · Welcomed Armstrong Garden Center to the City. Mayor Pro Tem Kawashima · Announced the Pioneer Park groundbreaking on Friday, August 8, 2003; · Expressed commitment to the development and enhancement of the downtown area. Mayor Worley · Reported on the League of California Cities conference in Monterey, CA. ADJOURNMENT - Mayor Worley adjourned the meeting at 7:26 p.m. The next regular meeting of the City Council was scheduled for Monday, August 4, 2003, at 7:00 p.m. in the Council Chamber at 300 Centennial Way.
