Corn TO: HONORABLE MAYOR AND CITY COUNCIL FROM: COMMUNITY DEVELOPIqENT DEPARTHEIFr SUBJECT: RECOVERY OF CITY z#CURRED COSTS OF ABATEAEIJT OF A PUBLZC NUISANCE LOCATED AT 17592 A~IAGANSET ICkY RECOIIqE#DATZO#: After conducting the required public hearing It ts recommended that the City Counct1 assess the charges of five thousand four hundred and seven dollars and thirty cents ($5,407.30) against the property as a special assessment and lien (see attached Exhtblt A). After assessing the lien, the Council may want to discuss alternative mechanisms In achieving total compliance wtth prior notices of abating the nutsance of the entt re property. BACKGROUND AND DzSCUSSZON: The Ctty Counctl adopted Resolution No. 85-116 In December, 1985 to eliminate the public nuisance at 17592 Amaganset Nay (see attached Exhibit B). After several conversations with the owner, some work began however, it was subsequently discontinued. In July, 1987, a second Notice and Order was issued to abate the public nuisance (see attached Exhibit C). The property owner failed to comply thus the City authorized necessary action to abate a public' nuisance on the exterior premises only. At this time the residence remains vacant and still constitutes a nuisance to the surrounding neighbors. The owner was notified to complete all inside renovation work by August 10, 1987, and has failed to comply. All work under current building permits has been abandoned and permits will expire on October 15, 1987. CONSLUSION: To eliminate the public nuisance and return the subject house into a habitable condition, staff recommends that the City Attorney file an injunction on the property owner to complete all remaining work and maintain the property in a safe and neat manner. If not complied with, said owner would then be in contempt of court and thus be punishable by imprisonment and/or fines under the' 1 aw. B~X~OUND: The City Council initiated a public nuisance proceeding back in December of 1985 for the property located at 17592 'A~ganset, adopting Resolution No. 85-116. The ~ner of the subject property was again issued a supple~ntal ~ notice t° abate all substandard conditions on the property tn July, 1987. Due to the failure of the property ~ner to obey the Notice and Order, the BUilding Official, tn conjunction with the Public Works Depar~nt, ordered the work to be acco~ltshed. Per the direction of the Building Official the City perfor~d all .needed work. Pursuant to the Uniform Code for the Abatement of Dangerous Buildings, the cost of such work ~y be rode a special assess~nt against the property involved or ~de a personal obligation of the property ~ner. A report speciftytng the work co~leted, itemized and total cost of the work, the description of the real property upon which the building was located and the name and address on the record ~ner of the property ts on file with the City Clerk's office. The City Council ~st n~ determine and authorize a public hearing to receive any protests or objections to the work charges being imposed as a personal obligation on the p~ope~ty owner or an assess~nt against the property involved.
