HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR MAIN STREET FACILITIES IMPROVEMENTS PROJECT (CIP NOS. 6103 & 6108) SUMMARY This action consists of the acceptance of work and authorization of recordation of the Notice of Completion for the Main Street Facilities Improvements Project (CIP Nos. 6103 & 6108). RECOMMENDATION It is recommended that the Tustin City Council adopt Resolution No. 03-67 accepting said work and authorizing the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release of Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no other claims or stop payment notices are filed, it is further recommended that the City Council authorize payment of the retention amount, thirty-five (35) days after the date of recordation of the Notice of Completion. The amount of retention currently being held equals $339,915.85. This amount together with previous payments total $6,798,316.91 and represents 100% of the final contract cost. FISCAL IMPACT The final cost of the construction contract is $6,798,316.91. The project construction was funded from the City's Water Capital Improvement Program Fund, and a $1,000,000 Conjunctive Use Program loan from the Orange County Water District for the construction of Main Street Well No. 4. Project construction has increased the City's infrastructure assets by $8,120,317. This increased infrastructure valuation will be added to the City's infrastructure inventory as required by Statement 34 of the Governmental Accounting Standards Board (GASB 34). Detailed cost information is shown on the attached GASB 34 Infrastructure Inventory Valuation Form. Final Acceptance of Public Improvements and Authorizing Recordation of Notice of Completion for Main Street Facilities Improvements Project (CIP Nos. 6103 & 6108) August 4, 2003 Page 2 BACKGROUND This project consists of a 2.2 million gallon underground reinforced concrete reservoir, a 4,000 gallon per minute capacity booster pumping station, a 1,400 gallon per minute well, a 750 kW emergency generator, upgraded blending and disinfection facilities, public parking lots and seating areas, and a fountain. The new buildings and lighting standards were designed to be compatible with the architectural style of the Old Town and Civic Center areas. All of the work for this project has been completed to the satisfaction of the City Engineer, and the project is now ready for City Council acceptance. Ragland ~' Water Services Manager RESOLUTION NO. 03-67 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORK OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR MAIN STREET FACILITIES IMPROVEMENTS (CIP Nos. 6103 & 6108) WHEREAS, SSC Construction, Inc. having a contract with the City Council to provide the hereinafter described public work and improvement; and WHEREAS, the City Engineer has duly certified to the completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement is found to be complete, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Main Street Facilities Improvements (CIP Nos. 6103 & 6108) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the Acceptance of said public works and improvement described herein as required by law.
