RECREATION AREA, ANO PRIVATE STREETS IN SUBSTANTIAL COHPLIANCE WITH TENTATIVE TRACT 12719. RECOI~ENDATION: That the City Council approve Final Tract Map 13044 (formerly 12719) by the adoption of Resolution No. 87-40. BACKGROUND: Final Tract Map No. 12345 was approved by the City Council on May 5, 1986 by adoption of Resolution No. 86-55.. This map subdivided the area westerly of the auto center known as Phase I Residential. As permitted by the Subdivision Map Act, developers may submit multiple final maps providing each such map is in compliance with the approved tentative. A final map, 12868, was submitted for a portion of the project (75 lots) approved by Tentative Tract Map 12719. The City Council, at its meeting of November 3, 1986 approved Final Tract Map 12868. The Bren Company is now requesting a second in a series of three final maps for final authorization to subdivide 127 individual lots along with lots for common areas and private streets. This action will leave 16 numbered and two lettered lots as the balance of Tentative Tract Map 12719. On March 10, 1987 the Planning Commission recommended to the City Council approval of Final Tract 13044 by the adoption of Resolution No. 2397. DISCUSSION: As originally filed, Final Tract 13044 was submitted as Final Tract 1271g. However, pursuant to the Subdivision Map Act, if that map number had been processed the balance of the project originally approved (see attached exhibit) would have lost standing granted by Tentative Tract 12719. In other words, the last final map (in a multiple map project) that is filed must bear the number of the Tentative Tract authorizing initial subdivision. The end result of this action would have been that a new Tentative Map process would have imposed on the developer creating an undue hardship to the property owner. City Council Report Final Map 13044 page two Further explantng the need for distinction between final maps is the fact that the remaining 16 numbered and two lettered lots of Tentative Tract 12719 cannot be developed until the disposition of that area for flood control and/or road purposes is finalized. Approval of a final map for this area at this time would have authorized development in conflict with previously approved subdivision actions. The proposed final map renumbered 13044 is in conformance with the Tustin Area General Plan. The Planned Community District Regulations adopted July 1, 1985 (Ordinance No. 938), is in substantial compliance with Tentative Map 12719 and all conditions of approval have been met. The City Council finds and determines as follows: That Final Tract Map No. 13044 was submitted to the City Council on behalf of the Bren Company to subdivide one {1) numbered and four (4) lettered lots into 127 numbered and five lettered lots for a residential subdivision for single family residential units for the property previously known as lots 5, E,F,I and J of Tract 12345. That an Environmental Impact Report (EIR 84-3) was previously certified for this project. C. That the proposed division is in conformance with the Tustin Area General Plan and the Tustin Zoning Code as it pertains to the development of single family dwellings and the Planned Community regulations for East Tustin Phase I. D. That the final map is in substantial Compliance with the Tentative Tract Map 12719. II. The City Council hereby approves Final Tract Map No. 13044 subject to final approval of the City Engineer.
