Recommendation
That Council adopt the amendment to Tustin City Ordinance No. 952
relative to the parking of commercial vehicles and allowing
towaway for violation as drafted by the City Attorney.
Background
On February 2, 1987, 'Council directed the City Attorney to revise
Tustin City Ordinance No. 952 to allow towaway for violation.

Please find attached a draft Ordinance of the City Council
of the City of Tustin amending the City's Ordinance No. 952
relative to the parking of commercial vehicles and allowing tow
away for violation. If the proposed Ordinance meets with your
satisfaction, this matter should be put on the City Council's
agenda for adoption of the Ordinance.

ORDINANCE NO. 982
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, AMENDING ORDINANCE NO. 952 RELATING TO PARKING
OF COMMERCIAL VEHICLES
WHEREAS, the parking of commercial vehicles in violation
City Code traffic regulations may create unsafe traffic
conditions.

THEREFORE, the City Council of the City of Tustin hereby ordains as
follows:
Section 1: Ordinance No. 952 shall be revised in its entirety to
reflect that commercial vehicles parked in violation of Tustin's traffic
regulations may be towed away for violation.
Section 2: Tustin City Code Section 5340(5)(d) is revised to read
as follows:
d. Parking of Commercial Vehicles
(1) No person shall stop, stand or park any vehicle of an
unladen weight of six thousand (6,000) pounds or over on any
public street, highway, thoroughfare or alley for a period
of more than two (2) consecutive hours in any part of the
City except:
(a) while loading or unloading property for such time
as is reasonably necessary to complete said work; or
(b) when such vehicle is parked in connection with, and
in aid of, the performance of a service to or on a
property in the block in which such vehicle is parked,
for a time reasonably necessary to complete such
service; provided, however, that there shall be
specifically excluded from the provisions of this
section pick-up trucks, panel trucks, station wagons and
limousines; (See California Vehicle Code Section 390 re
weight ratings; see Health. and Safety Code Section 18255
regarding parking of mobile homes); and provided
further, however, that upon a showing of special
circumstances, the Police Department may grant a special
permit for parking for a.period not to exceed twenty-
four (24) consecutive hours.
(2) Any commercial vehicle which is parked or left standing
upon a street or highway in violation of this section may be
removed or caused to be removed by any regularly employed
and salaried officer or other employee or officer of the
Police Department of this City designated by separate
ordinance.
