RECOMMENDATION~
For the City Council meeting of March 16, 1987.
Approve the concept of the formation of a 1972 Landscape and Lighting District
within the East Tustin area and direct staff to solicit proposals from consultants
to provide the engineering services for the formation of said District.
)ACKGROUND:
On Febnuary 6, 1987, the City Manager circulated a memorandum concerhing the
proposed Landscape Maintenance District within the East Tustin area. This memo
provided a general outline of the scope of the proposed district and some .of the
general reasons for said formation which are recapped below.
Currently, the East Tustin Specific Plan requires The Irvine Company to provide
landscaping along the arterial roadways. This landscaping would be located within
the area between the back edge of sidewalk and the exterior walls of the .adjoining
subdivisions, and the adjoining homeowner's associations would be responsible for
the maintenance of said areas.
DISCUSSION:
Both the City and Irvine Company staffs agree that several different homeowner's
associations could result in.a varied level of maintenance on the landscaped areas
due to freqgency of maintenance and adequate funding through homeowner's
associations. The formation of a master landowner's association has been utilized
in other cities and found to be impractical for this purpose.
An alternative to having the individual homeowner's association perform the
maintenance would be for the formation of an assessment district that would he
responsible for said maintenance on an on-going basis. The formation of this
assessment district .would require The Irvine Company to dedicate to the City all
if said landscape lots along the arterial roadways lying between the back edge of
Jhe sidewalk and the subdivision walls. It is estimated that the cost of said
maintenance would be approximately $10-$12 per month/parcel. The property owner
would be assessed through the property tax bill in lieu of paying the monthly cost
as a part of the homeowner's association fees. The assessment district would be
administrated by the City and all City costs would be included in the monthly
assessment resulting in no additional City expenditures.

The proposed assessment district would not include the maintenance of all. the
landscaped median islands. These would be maintained by City staff as they are
throughout the remaining areas of the City.
A map is attached which shows the landscaped areas to be included within the
subject assessment district. It is proposed to include these areas within the
City of Tustin 1972 Landscape and Lighting District which has been previously
established over the southerly portion of the East Tustin area.
