HUSTO#, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT PROPOSED ANNEXATION NO. 142 LA COLINA/BEYERLY GLEN DRIVE RECOMMENDATION: Adopt Resolution No. 87-34 which petitions the Local Agency Formation Commission to proceed with proposed Annexation No. 142 La Colina/Beverly Glen Drive. BACKGROUND AND DISCUSSION: The Cortese-Knox Local Government Reorganization Act of 1985 authorizes the City Counctl to make application to L.A.F.C.O for the annexation of territory after the adoptton of a resolution. [n the past it has been City Council policy to lnttiate annexations when citizens of the area had ftled a petitlon with the City. A group of citizens who live in the proposed annexation area have gathered signatures for annexation. The area is generally bounded by La Coltna on the south, The Tustin Ranch Road on the east, Beverly Glen Drive on the west, and lots fronting on Theta Road on the north with a westerly boundary approximately 500+ feet west of Browning {see attached map). The area is approximately 80 acres in size and consists of approximately 140 single-family residences with an estimated population of approximately 532 persons. The Zoning for the area is E-4 (Estate Residential). If the City Council adopts the attached resolution, the Local Agency Formation Commission then conducts a fact finding hearing to determine if the subject proposal meets the requirements of the Government Code. Upon LAFCO's determination, the matter is referred to the City Council as the "conducting authority" for a protest hearing. In the case of inhabited March 2, 1987 Proposed Annexation No. 142 Page two territory, if less than 25% of the registered voters of the area file a protest than the "conducting authority" orders the annexation without an election. If 25% to 50% of the registered voters of the area file a protest then the "conducting authority" must order an election. If more that 50% of the registered voters protest then the annexation would be terminated. Director of Community. Development CS:do Attachments: Map Resolution No. 87-34 ~ i Community Developme, m Dopar~men~ ~ 1 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 25 26 27 28 RESOLUTION NO. 87-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, MAKING APPLICATION FOR THE ANNEXATION OF TERRITORY KNOWN AS LA COLINA/BEVERLY GLEN ANNEXATION NO. 142 WHEREAS, the City Council of the City of Tustin on its own motion has initiated preliminary proceedings for the annexation of certain inhabited territory; and WHEREAS, the City of Tusttn has the ability to extend the full range of municipal services to the subject territory to better serve the needs of the residents of the area; and WHEREAS, the City Council on March 2, 1987 did adopt a resolution of application for annexation of the subject territory to the City of Tustin; and WHEREAS, the City Council has determined that the proposed annexation is a Categorical Class 19 exemption from the requirements of CEQA; NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Tustin, California that: 1. The proposal for the La Colina/Beverly Glen Annexation No. 142 to the City of Tusttn is made pursuant to Part 3, Chapter 1 of the COrtese-Knox Local Government Reorganization Act of 1985. The proposed change of organization consists of the annexation of approximately 80 acres of inhabited territory, surrounded by the incorporated limits of the City of Tustin, and the County of Orange, and said territo~y will derive benefits of full municipal services as a result of the annexation. The subject territory is bounded by La Colina Avenue on the north, The Tustin Ranch Road on the east, Beverly Glen and lots on Theta Road on the north, with a westerly border approximately 500+ feet west of Browning. 4. The proposed annexation is made for the purpose of increasing the economy and efficiency of government services by incorporating territory within the City's sphere of influence. 5.
