Receive the City Engineer's Report dated 9/14/87. 2. Conduct the public hearing. 3. Adopt resolution establishing Underground Utility District Ho. 9 and order the conversion. 4. Authorize supplemental appropriation from General Fund monies in the amount of $1,000. BACKGROUND: On September 8, 1987, City Council adopted Resolution No. 87-98 which declared its intention to form an underground utility district on First Street and set a public hearing on the matter for 7:00 p.m. Wednesday, October 7, 1987. A copy of this resolution and the City Engineer's Report have been furnished to the three affected utility companies: Edison, Pacific Bell, and American Cable. American Cable did not respond to our letters, but we do believe that they have some overhead facilities on existing Edison poles. No private service reconnections will be required, so there will be no costs to private property owners. ANALYSIS: Twenty wood utility poles and 17 obsolete metal street light poles, all with overhead wiring, will be removed. Eighteen new marbelite street light poles will be installed. Edison's cost is estimated at $375,000, to be paid for with Rule 20A funds set aside for this purpose for the City of Tustin. The City's cost is estimated at $1,000 to cover the additional street light. The work is anticipated to start next January and to be completed by May 1, 1988. Bob Ledendecker Ronald E. At their meeting of September 8, 1987, the City Council of the City of Tustin, California adopted Resolution No. 87-98 setting a public hearing for 7:00 p.m. on October 7, 1987 to consider the merits of establishing an underground utility district along First Street between Prospect Avenue and Newport Avenue, and more particularly described and shown on Exhibit "A" attached hereto. Meetings have been held with both the Southern California Edison Company and Pacific Bell to determine costs invo'ved. American Cablevision has some overhead facilities within the district, but per terms of the City's franchise agreement with American Cablevision, they will be requi~ed to underground these facilities at no cost to district. Funding will be provided by the Edison Company with Rule 20A funds for their facilities and Pacific Bell will provide funding for all of their company-owned facilities. The City .of Tustin will provide funding for one additional street light which~ is not eligible for Rule 20A funds. The estimated cost of the proposed underground work is as follows: Edison Co. cost for conduit, structure and cable (Rule 20A) .............................. $375,000 Pacific Bell cost for conduit, structure and cable ............................... $ 15,000 City cost for one street light ..................... $ 1,000 There will be no property owner conversion expense. All other existing private utility service lines are presently undergrounded or are outside the proposed district. -1- Initial indications by the utility companies are that their work can be completed six months from now, or about May 1, 1988. This district will provide for the removal of all poles with overhead wires along both sides of First Street between Prospect Avenue and Newport Avenue. There will be 20 wooden power 'poles with overhead wires and 17 obsolete metal street light poles ~th overhead wires removed. WHEREAS, by Resolution No. 87-98 a public hearing was called for ? October 7, 1987, at the hour of 7:00 p.m. in the Council Chambers of the City of Tustin, California, to ascertain whether the public necessity, health, 8 safety, or welfare requires the removal of poles, overhead wires and associated structuresand the underground installation of wires and facilities for 9 supplying electrical, communication, or similar or associated service, within that certain area of the City of Tustin more particularly described in the 10 legal description and shown on a map marked Exhibit "A" attached hereto. 1] WHEREAS, notice of such hearing has been given to all affected property owners, if any, as such are shown on the last equalized assessment roll an,d to 12 all utilities concerned in the manner and time required by law; and 13 WHEREAS, such hearing has been duly and regularly held and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, the Council of the City of Tustin does hereby resolve: 1. The Council hereby finds and determines that the public necessity, 16 health, safety and welfare require the removal of poles, overhead wires and associated structures, 1) to eliminate concentrations of overhead distribution l? facilities, 2) to clear streets used extensively by the general public, which carry a heavy volume of vehicular traffic, and to clear streets which pass 18 through a civic area, and the underground installation of wires, and facilities for supplying electric, communication or similar or associated Service in the 19 underground district described in Exhibit "A" attached hereto and made a part hereof by this reference, and pursuant to the provisions of Article 7, Chapter 20 5 of the Tustin City Code, such area is hereby established as Underground Utility District No. 9, First Street between Prospect Avenue and Newport 2! Avenue. 22 2. The City Council hereby declares said designated area to be an Underground Utility District and orders all overhead wires, poles and 23 associated overhead structures to be removed and facilities installed underground. 3. The Council does hereby fix May 1, 1988, as the date on which ~ affected property owners, if any, must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated 26 overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service within 27 Underground Utility District No. 9, First Street, on or before May 1, 1988. 28 4. The City Clerk is hereby instructed to notify al.1 affected utilities and all persons owning real property, if any, within Underground Utility District No. 9, First Street, of the adoption of this resolution within ten (10) days after the date of such adoption. Said City Clerk shall further notify said property owners, if any, of the necessity that, if they or any ~erson occupying such property desire to continue to receive electric communication or other similar or associated service, they or such occupant shall, by the date fixed in this ordinance, provide all necessary facility chan~es on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this resolution together with a copy of said Article 7, Chapter 5 of the Tustin City Code, together with a statement that the City Engineer's Report containing details of the district is available for Inspection by the public in the office of the City Clerk, to all affected property owners as such are shown on the last equalized assessment roll and to all utilities affected by this Resolution.
