SUBJECT: RESOLUTION OF CONFIRMATION OF MASTER TAX AGREEMENT FOR PROPOSED
FAIRHAVEN ANNEXATION NO. 1~

Adopt of Resolution No. 87-108 confirming the application of the Master Property
Tax Transfer Agreement to the proposed Fairhaven Annexation No. 144.
PRO~ECT ANALYSIS:
Fhe City Council is considering a petition filed by County residents to adopt a
resolution of application for the inhabited annexation area known as Fairhaven
Annexation No. 144.
Section 99(d) of the Revenue and Taxation Code requires the City and County to
approve the exchange of property tax revenue prior to consideration of the
application by the Local Agency Formation Commission.

3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, CONFIRMING THE APPLICATION OF THE
4 MASTER PROPERTY TAX TRANSFER AGREEMENT TO THE PROPOSED
FAIRHAVEN ANNEXATION NO. 144

WHEREAS, a MASTER PROPERTY TAX TRANSFER AGREEMENT BETWEEN THE COUNTY
0 OF ORANGE AND THE CITY OF TUSTIN TO PROVIDE FOR PROPERTY TAX EXCHANGE IN
AREAS ANNEXED BY THE CITY has been executed by the Board of Supervisors of
? Orange County and the 'City Council of the City of Tustin. Effective
November 18, 1980 the agreement provides for division of property taxes
8 pursuant to Section gg(d) of the Revenue and Taxation Code of the State of
California; and

WHEREAS, the City Council of Tustin has proposed the annexation of
10 the inhabited and developed area known as Fatrhaven Annexation No. 144.
11 NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of
Tustin.that the MASTER PROPERTY TAX TRANSFER AGREEMENT BETWEEN THE COUNTY
12 OF ORANGE AND THE CITY OF TUSTIN TO PROVIDE FOR PROPERTY TAX EXCHANGE IN
AREAS ANNEXED BY THE CITY providing for the allocation of property tax
13 revenues, as approved by the Board of Supervisors and the City Council and
effective November 18, 1980, shall be applicable to the territory within
14 the proposed Fatrhaven Annexation No. 144 to the City of Tusttn for the
annexation of 160.28 acres as substantially developed property.
