RECOF~ENDATION:
Staff recommends approval of Zone Change 85-10
1. Have first reading of Ordinance by Eitle only;
2. Introduce Ordinance No. 950.
BACKGROUND:
Earlier this year, staff conducted a survey of all properties in the city that
required either a General Plan Amendment or Zone Change in order that both
documents would be in conformance, a requirement of State law. The City Council
directed staff to start proceedings and bring these changes before the Planning
Commision and City Council for implementation. To date, the General Plan
Amendments have been completed and the Zone Changes have been before the
Commission. Each Zone Change has been recommended for change by the Commission
to the Council by a vote of five ayes to zero noes.
This is the sixth and last zone change.

DISCUSSION:
A church is located at 12931 Irvine, with an Orange County fire station at 1201
Irvine Blvd., both recently annexed into the city with a R-1 {Single Family
Residential) zoning district. The General Plan land use designation reflects
the tax exempt status of both properties, which is Public & Institutional.
Staff recommends that the zoning district be changed to reflect the existing
uses and General Plan, to Public & Institutional District (P&I).

ORDINANCE No. 950
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, REZONING 12931 AND 1201 IRVINE BOULEVARD
FROM SINGLE FAMILY RESIDENTIAL DISTRICT {R-l) TO
PUBLIC AND INSTITUTIONAL DISTRICT {P&I) AS SHOWN
IN EXHIBIT "A". '
The City Council of the City of Tustin does hereby ordain as follows:
I. The City Council finds and determines as follows:
A. That a proper application, {Zone Change No. 85-10) has been
filed by the City of Tustin to change the zone for 12931 and
1201 Irvine Boulevard from Residential Single Family District
(R-l) to Public and Institutional District (P&I) as shown in
Exhibit "A".
B. That a public hearing was duly called, noticed and held on said
application.
That a zone change should be granted for the Following reasons:
1. That the proposed change would bring the Tustin Area
General Plan in conformance with the Zoning Map.
That the proposed change would not be detrimental to the
public health, safety, and welfare of the surrounding
property owners.
D. Development of subject property shall be in accordance with the
policies adopted by the City Council; Uniform Building Codes as
administered by the Building Official; Uniform Fire Code as
administered by the Orange County Fire Marshal; and street
improvement requirements as administered by the City Engineer.
E. In accordance with the requirements of the California
Environmental Quality Act Guidelines, the subject project will
not have a significant impact on the environment and therefore a
Negative Declaration is hereby adopted.
F. That the Planning Commission adopted Resolution No. 2235
recommending approval of Zone Change 85-10 to the City Council.

II. The City Council hereby adopts Zone Change No. 85-10 from Residential
Single Family District {R-l) to Public and Institutional {P&I) for
12931 and 12011rvine Boulevard, as shown in Exhibit "A".

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN,
RECOMMENDING REZONING OF 12931 AND 1201 IRVINE BOULEVARD FROM
SINGLE FAMILY RESIDENTIAL DISTRICT (R-l) TO PUBLIC AND
INSTITUTIONAL DISTRICT (P&I), AS SHOWN IN EXHIBIT "A".
The Planning Commission of the City of Tusti'n does hereby resolve as
follows:

The Planning Commission finds and determines as follows:
