GRANT OF EASEMENT - COLUMBUS TUSTIN PARKSITE
RECOMMENDATION:
That the Tustin City Council, at their meeting of October 21, 1985, approve the
Grant of Easement at Columbus-Tustin Parksite to the Southern California Edison
Company to provide the required electrical service to public facilities and
authorize the Mayor to execute the required Grand of Easement Deed.
BACKGROUND:
As a part of the recent improvements to a portion of the Columbus-Tustin Parksite,
the Southern California Edison Company was required to install conduit and
electrical conductor along a portion of Beneta Way to provide electrical service
to the parks irrigation system and some newly installed street lights.
DISCUSSION:
In order not to remove and replace existingconcrete sidewalk, the required
electrical facilities were placed within an area adjacent to and southerly of a
portion of the sidewalk along the southerly side of Beneta Way. The placement of
these facilities outside of the public right-of-way and within the Columbus-Tustin
Park right-of-way requires a six (6) foot wide easement immediately adjacent to
and southerly of the sidewalk along a portion of Beneta Way.
The attached Grant of Easement document and sketch provides for this easement to
be granted by the City of Tustin to the Southern California Edison Co.

CITY 'bF TUST[N, a Hunicipal corporation (hereinafter referred to as 'Grantor"), hereby grants to
SOUTHER~ CAL[FORNIA EOISON CO~J~AI~y, a corporation, its successors and assigns (hereinafter referred to as
"Grantee'), an easement and right of way to construct, use, maintain, operate, alter, add to, repair,
replace, reconstruct, inspect and re~,~ve at any time and fram time to time underground electrical supply
systems and cmmunication systems (hereinafter referred to as "systems"), consisting of wires, underground
conduits, cables, vaults, manholes, handholes, and including above-<jround enclosures, markers and concrete
pads and other appurtenant fixtures and equipment necessary or useful for distributing electrical energy
and for transmitting intelligence by electrical means, in, on, over, under, across and along that certain
real property in the County of ORANGE, State of Caltforota, described as follows:
The northwesterly 6 feet and the northerly 6 feet of the westerly 145 feet of that portion of the land in
the City of Tustin, County of Orange, State of California, allotted to Leonor Yorba de Rowland by the
Final Decroe of Partition of the Rancho Santiago de Santa Rna, ~hich was entered September 12, 1868 in
Book 'B", page 410 of Judgments of the 0istrict Court of the 17th Judicial Oistrict in and for Los Angeles
County, California, described in deed to the Orange County Flood Control 0istrict, recorded Septe~t~er 19,
1962 in Book 6253, page 9S1 of 0fficial Records in the Office of the County Recorder of said Orange County.
EXCEPT that portion thereof lying northerly of the southerly line and its westerly prolongation of the
land described as "Parcel ~o. 1' in deed to County of Orange, recorded August 12, 1970, in Book 9373, page
782 of said Officlal Records.
ALSO EXCEPT that portion thereof included within the land described as "Parcel I~o. 1.1" in said last
mentioned deed.
The Grantor agrees for itself, its successors and assigns not to erect, place or maintain, nor to
permit the erection, placement or maintenance of any building, planter boxes, earth fill or other
structures except ~alls and fences on the above described real property. The Grantee, and its
contractors, agents and ea~loyees, shall have the right to trim or cut tree roots as may endanger or
interfere with said systems and shall have free access to said systems and every part thereof, at all
times, for the purpose of exercising the rights herein granted; provided, however, that in making any
excavation on said property of the Grantor(s), the Grantee shall make the same in such a manner as will
cause the least injury to the surface of the ground around such excavation, and shall replace the earth so
removed by it and restore the surface of the ground to as near the sane condition as it was prior to such
excavation as is practicable.
