COUNCIL POLICY CONCERNING BUILOING SETBACKS FROM FUTURE
RIGHT-OF-NAY LINES
RECOI~ENDATION:
Staff recommends the City Council schedule the subject topic for discussion at a
joint meeting of the Planning Commission and City Council.
BACKGROUND:
The Planning Commission requests Council to provide policy concerning the
adherence to zoning setback standards in relation to future right-of-way lines.
Specifically, where additional street right-of-way is required should the
building's setback be calculated from the existing right-of-way line or the
future right-of-way line?
DISCUSSION:
During consideration by the Planning Commission of recent development projects,
questions were posed concerning the appropriate line from which to measure
building setbacks. As an example, where a commercial zone may require a 10 feet
building setback yet an additional 10 feet of right-of-way is a condition of
approval, should the building be placed 10 feet from the present line or 20
feet?
Since this question is a policy issue, staff suggests this policy be a topic for
a joint Commission/Council workshop in the near future.
