REQUEST: TO RESUBDIVIDE THREE PARCELS FOR THE PURPOSE OF CREATING ~
SEPARATE LOTS FOR AUTOIqOBILE SALES SITES.
RECOI~ENDED ACTION:
It is recommended that the City Council approve Tentative Parcel Map 87-370 by
the adoption of Resolution No. 87-123.
BACKGROUND:
In June, 1985 the Tustin Auto Center was created by final approval of a Parcel
Map (84-1032) which subdivided 56 acres into 12 numbered parcels for auto
dealerships.
The applicant is now requesting authorization to resubdivide three (3) parcels
for the purpose of creating two (2) separate auto sales facilities. Both of
these auto dealerships will be owned and operated by Mac Pherson Properties.
The dealership on proposed Lot I will be for Ford Motor Company products and
proposed Lot 2 will be a facility for a Hyundai dealership.
The subject properties to be resubdivtded are currently vacant with all street
· and public improvements in place. The site is bordered on all sides by Auto
Center Drive. The balance of the Auto Center is reserved for new car
dealerships, three (3) of which are in operation with a fourth currently under
construction.

Although the design ~f the proposed auto dealerships does not require City
Council review, development plans propose eight (8) buildings which will total
74,730 square feet or'19% of the enttre stte, a parktng and circulation area of
166,013 square feet or 43% of the site, and a dtsplay area of ~23,~00 square
feet or 32% of the site, and landscaped area of 22,185 square feet or 6% of the
site.
The subject slte ts a modtfted ctrcular shape whtch wtll incorporate perimeter
landscaping consisting of palm trees and turf. In addition to perimeter
landscaping the tntertor of the lot wtll be landscaped In conformance with the
Auto Center Landscaping Guidelines.
Proposed structures incorporate the use of a Spanish Mtsston style of
architecture with .stucco walls and barrel ttle roofs. All proposed structures
are In cOnformance wtth the Auto Center Architectural Guidelines.
The Planntng Commission reviewed and recommended approval of this Tentative
Parcel Map on October 12, 1987. Stnce this revtew, one condition has been added
to require a reciprocal tngress, egress and parklng agreement between both
properties In order to facilitate proper on-slte circulation.
CONCLUSION:
The proposed map is in conformance with the Tustln Auto Center Guidelines and
the Subdivision Map Act~ Therefore, staff recommends that the City Council
adopt the attached Resolution No. 87-123 approving Parcel Map 87-370.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 TUSTIN, APPROVING TENTATIVE PARCEL MAP 87-370 LOCATED
AT 2, 33, 2! AUTO CENTER DRIVE
The City Council of the City of Tustin does hereby resolve as follows:
I. The City Council finds and determines as follows:
? A. Tentative Parcel Map No. 87-370 was submitted to the City
Council pursuant to Ordinance No. 847 by K. W. Lawler &
Assoiciates, Inc. on behalf of Mac Pherson Properties and the
8 Irvine Company, requesting authorization to resubdivide three
(3) parcels into two (2) parcels for Parcels 10, 11 and 12 of
9 Parcel Map 84-1032 as recorded in Book 200, Pages 19 through 24
in the Office of the County Recorder of Orange County.

B. A public hearing was duly called, noticed and held by the
1] Planning Commission on October 12, 1987 for said map.
12 C. This project is Categorically Exempt, Class 15 from the
requirements of the California Environmental Quality Act for the
13 subject project area.
14 D. The proposed subdivision is in conformance with the Tustln Area
General Plan, adopted East Tustin Specific Plan, Tustin Auto
15 Center Guidelines, East Tustin Development Agreement and
Subdivision Map Act.
E. The site is physically suitable for the type of development
17 proposed.
18 F. The site is physically suitable for the proposed density of
development.

G. The design of the subdivision or the proposed improvements are
20 not likely to cause substantial environmental damage or
avoidably injure fish or wildlife in their habitat.
H. The design of the subdivision or the type of improvements
22 proposed will not conflict with easements acquired by the
public-at-large, for access through or use of the property
23 within the proposed subdivision.
24 I. The design of the subdivision or the types of improvements
proposed are not likely to cause serious public health problems.

CONDITIONS OF APPROVAL FOR
TENTATIVE PARCEL MAP 87-370
PUBLIC/PRIVATE INFRASTRUCTURE IMPROVEMENTS
1.11 Any damage done to existing street improvements and utilities shall be
repaired before issuance of a Certificate of Occupancy for development
on either parcel.
1.13 Prior to any work in the public right-of-way, an Excavation Permit must
be obtained (and applicable fees paid) from the Public Works
Department.
GRADING/DRAINAGE
2.1 Preparation and submittal of final grading plans delineating the
following is required prior to approval of Final Map.
A. Final street elevations at key locations
B. Final pad/finish floor elevations and key elevations for all site
grading. All final pad elevations to be a minimum of 1.0 feet above
the base flood elevation as defined by FEMA.
C. All flood hazard areas of record must be shown.
2.2 Prior to issuance of precise grading permits, a detailed soil
engineering report shall be submitted to and approved by the Building
Official conforming to the requirements of the Uniform Building Code
and City Grading Requirements.
2.3 Prior to issuance of grading permits, preparation and submittal of a
grading plan subject to approval of the Department of Community
Development delineating the following information:
A. Methods of drainage in accordance with all applicable City
standards.
B. All recommendations submitted by geotechnical or soil engineer and
specifically approved by them.
C. Compliance with conceptual grading shown on Tentative Parcel Map.
D. A drainage plan and necessary support documents to comply with the
following requirements:
1) Provision of drainage facilities to remove any flood hazard to
the satisfaction of the City Engineer which will allow building
pads to be safe from inundation from rain fall which may be
expected from all storms up to and including the theoretical 100
year storm and dedication of any necessary easements on the
final map as required.
- 2) Elimination of any sheet flow and ponding.
3) Provision of drainage facilities to protect the lots from any
high velocity scouring action.

4) Provision for contributory dratnage from adjoining properties.
E. All flood hazard areas of record.
F. A note shall be placed on the gradtng plan requiring Community
Development Department approval of rough gradtng prtor to ftnal
clearance for foundations. The Department wtll tnspect the stte for
accuracy of elevations, slope gradients, etc. and may requtre
certification of any grading related matter.
2.4 Preparation of a sedimentation and eroston control plan for all
construction work related to the subject project Including a method of
control to prevent dust and windblown earth problems.
2.5 A precise gradtng Permit shall be tssued prior to tssuance of any
butldtng permtts wtthtn the subject project area.
2.6 A qualified paleontologtst/arcffealogtst, as appropriate shall be
present durtng rough gradJng operations. If resources are found, work
shall stop tn the affected area and all resources shall be excavated or
preserved as deemed appropriate or as recommended by the
paleontologtst/archealologfst subject to revtew and approval by the
Department of Publlc Works and Community Development. All "finds"
shall be reported Immediately to the Department of Community
Development.
The paleontologlst/archealoglst shall attend the pregrade construction
meettng to ensure that thts condition and necessary procedures tn the
event of a "ftnd" are explained.
2.7 All earthwork shall be performed In accordance with the Ctty of Tustln
Municipal Codes and grading requirements.

3.1 The subdivider shall comply wlth a11 requirements of the Orange County
Ftre Marshall, Including requtred ftre flow, Installation where
requtred of ftre hydrants subject to approval as to location by the
Fire Department, Ctty of Tusttn Publlc Works Department and [rvine
Ranch Water District, and compliance wtth all requirements pertaining
to construction.
3.2 Prior to tssuance of buJldtng permtts for combustible construction,
evidence that adequate water supply and operational ftre hydrants are
available for fire protection ts available shall be submitted and
approved by the Orange County Ftre Marshall. The subdivider shall also
submtt water improvement plans for approval of Ftre Marshal.

NOISE
4.1 All construction operations including engine warm up shall be subject
to the provisions of the City of Tusttn Noise Ordinance and shall take
place only during the hours of 7:00 a.m. until 6:00 p.m., Monday
through Friday unless the Building Official determines that said
activity will be in substantial conformance with the Noise Ordinance
and the public health and safety will not be impaired subject to
application being made at the time the permit for the work is awarded
or during progress of the work.
FEES
5.1 Prior to issuance of any Building Permits, payment shall be made of
required fees Including:
A. Major thoroughfare and bridge fees to Tusttn Public Works
Department.
B. Sanitary sewer connection fee to Orange County Sanitation District.
C. Grading planchecks and permit fees to the Community Development
Oepartment.
D. All appllcable Building plancheck and permit fees to the Community
Development Oepartment.
E. New development fees to the Community Development Department.
F. School facilities fee to the Tusttn Unified School District.
GENERAL
6.1 Within twenty four months from Tentative Parcel Map approval, the
Subdivider shall ftle wtth appropriate agencies, a Ftnal Map prepared
tn accordance with subdivision requirements of the Tusttn Municipal
Code, the State Subdivision Map Act, and applicable conditions
contained herein.
6.2 Prior to Ftnal Map approval, subdivider shall submtt a current title
report.

6.3 Subdivider shall conform to all applicable provisions of the City
Code. All requirements of the State Subdivision Map Act, the City's
Subdivision Ordinance and Zoning Ordinance shall be satisfied.
6.4 Subdivider shall submit- a duplicate mylar of the Final Map, or 8 1/2
inch by 11 inch transparency of each map sheet prior to final map
approval and "as built" grading, landscape and improvement plans prior
to certificate of acceptance.
6.5 All easements of record shall be shown on the Final Map.
6.6 The applicant shall record a reciprocal access and parking agreement
between both parcels. This agreement must be reviewed and approved
prior to Final Parcel Map approval.
