WICK, ASSISTANT CITY ENGINEER COOPERATIVE AGREEMENT WITH CITY OF SANTA ANA FOR SLURRY SEALING OF RED HILL AVENUE IN CONJUNCTION WITH F.Y. '85-'86 SLURRY SEAL PROGRAM RECOMMENDATION: It is recommended that the City Council, at their meeting of November 18, 1985, by minute order authorize the Mayor to sign and the City Clerk to attest to subject attached agreement. BACKGROUND: In conjunction with the City's F.Y. '85-'86 Slurry Seal Program we will be slurry sealing Red Hill Avenue between Warner and Barranca, a portion of which lies within the City of Santa Ana. By execution of the attached agreement, Santa Ana has agreed to pay their fair share of said work. The attached agreement follows the same format that has been used on other cooperative projects between Santa Ana and Tustin. Dale A. Wick Assistant City Engineer DAW:jr Attachment cc: City Clerk City Attorney Finance Director AGREEMENT FOR SLURRY SEAL OF A PORTION OF REDHILL AVENUE FROM THE NORTH CURB LINE OF WARNER AVENUE TO THE NORTH CURB LINE OF BARRANCA ROAD THIS AGREEMENT is made and entered into thls /~_~_~ by and between the CITY OF TUSTIN (hereinafter "Tu~ (hereinafter "Santa Ana'). ', WITNESSTH: day of 1985, and the~O1~ S~NTA ANA WHEREAS, Tustln and Santa Aha desire to slurry seal the portion of Redhill Avenue which runs from the north curb line of Warner Avenue southwesterly to the north curb line of Barranca Road. WHEREAS, the street to be improved lies generally within the corporate limits 'of Tusttn, but a portion of the street to be tnl~roved lies within the corporate limits of Santa Ana; and WHEREAS, engineering studies have indicated that a slurry seal of this portion of Redhill Avenue is necessary; and WHEREAS, construction has been scheduled to commence in of 1985; and WHEREAS, the parties hereto desire to provide for the slurry seal of portions of Redhill Avenue within both Tustin and Santa Ana and desire to provide for their porportionate share of costs thereof. NOW, THEREFORE, the parties hereto agree as follows: 1. Tustin shall prepare plans and specifications for the slurry seal of Redhill Avenue between the north curb line of Warner Avenue to the north curb line of Barranca Road and Santa Aha shall have a right of approval of said plans as they relate to Santa Ana. 2. Tustin shall advertise and award the contract for the slurry seal in accordance with State law. 3. Tustin shall administer the contract and shall supervise all work performed. 4. The cost of slurry and related work shall be paid for by the parties in proportion to the benefits received by each of the parties taking into consideration such factors as area or square footage improved, specific improvements added and other related factors. The parties agree that they will use their best efforts to determine their proportionate share of the costs and further agree to submit the matter to binding arbitration in the event they cannot agree. 5. Santa Ana agrees to pay for its proportionate share of all costs within 30 days after recordation of the Notice of Completion and after agreement as to proportionate share is reached, which it agrees not to unreasonably withhold. 6. Tustin shall require the contractor awarded the project to keep accurate and complete records on all phases of the project and for all expenditures and shall make those records available to Santa Ana at all reasonable times. 7. Upon recordation of the Notice of Completion, each party shall maintain those improvements which re~in within their respective corporate limits.
