CO~ISSION CONCERNS
White moved, McCarthy seconded to instruct staff to do a zoning amendment to
eliminate toxic waste transfer stations in the M zone. Motion carried S-O.
White commented on the third anniversary of three members serving on the Planning
Commission
White requested staff investigate the noises being emitted from possibly the Tustin
East Industrial Complex. The noise is intermittent throughout the night hours and
sounds like a beeper or paging system of some king.
Well presented Baker with a City of Tustin lapel pin.
Well recognized Mary Ann Chamberlain for being Chairman of the Orange County Housing
Authority Advisory Committee.

COI~I~ISSION CONCERNS
White recommended to Council that certain developments that fall within certain
use-by-right categories should require a site plan review and/or conditional use
permit by the Commission to ensure that public improvements on projects are
constructed.
Knight responded that staff could identify those areas where we may have a problem in
the city and then try to reach some kind of strategy where those improvements could
take place if development occurred. (Whether that is through a use permit or whatever
other process.) Staff will report back in 60 days.
Baker informed the Commission of the Chamber mixer Tuesday evening at City Hall.
Well congratulated staff on their handling of First Street Specific Plan and informed
the Commission of the upcoming study sessions.
White questioned the status of Specific Plan ~7. Mary Ann responded it will be
before the Commission very soon.
ADJOURNMENT
McCarthy moved, White seconded to adjourn at 8:50 p.m. They will convene at 6:30
p.m. on November 12, 1985 for a workshop regarding First Street Specific Plan. The
regularly scheduled Planning Commission meeting will convene at 7:30 p.m. November 1,
1985.

12. Final building elevations which indicate specific construction materials and
color schemas shall be submitted ~o the Planning Department for review and
approval prior to the issuance of building permits.
A landscape and irrigation plan incorporating specimen size trees and an
automatic irrigation system shall be submitted to the Planning Oeprtmant for
review and approval prior to the landscape installation This plan shall
include the retention of the trees indicated as L, 2 + 2 on ~-'xhibtt "B" attached,
and shall include at least f~ve [5) f~8' box trees to replace the mature trees
displaced by construction. Occupancy of any unit ~ll not be authorized until
approved landscaping is in place.
The developer shall com~ly with all construction requirements of the Orange
County Fire Marshal's office which includes installation of fire extinguishers
and on-site private fire hydrants if necessary.
A development plan shall be submitted to City staff, prior to issuance of
building permits to detailing amanities provided within the common recreation
ar~a; i.e. spas, walkways, tot lots.
A six foot eight inch (6'8') high, concrete block wall shall be installed along
the property side yards of the project. However, the bei~ht of the wall' along
the northern properLT llne may be constructed to & height up to eight feet
as a sound attenuation wall for the recreation and patio areas if so recommended
by an acoustical engineer.
An analysis of the project shall be conducted by an acoustical engineer verifying
that the project will comply with the City Ordinance ~o. 828 pertaining to noise.
Included in this analysis will be consideration of impacts of the I-S freeway
widening project.
~8. All roof top equipment shall be screened from public view.
The Final Tract Map shall be submitted, ready for recordation, prior to the
issuance of building permits. At such time that construction of the units is
complete, and all final inspections have been conducted, the Final Map shall be
reviewed by the City Council for consideration of approval.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN RECOMMENDING TO THE TUSTIN CIl~ COUNCIL
APPROVAL OF FINAL TRACT MAP NO. 12273
The Planning Commission of the city of Tustin does hereby resolve as
follows:
I. The Planning Commission finds and determines as follows:
A. That Final Tract Map No. 12273 was submitted to the Planning
Commission on behalf of Stk Wong for consideration of the
creation of a one lot subdi¥t'sion for condominium purposes at
15582 South "B" Street.
B. That a Negative Declaration for the project was previously
approved in conformance with the California Environmental
Quality Act.
C. That the proposed division is in conformance with the Tustin
Area General Plan and the Tustin Zoning Code as it pertains to
the development of multiple family dwellings.
D. That the final map is in substantial compliance with the
tentative map.
II. The Planning Commission hereby recommends to the City Council
approval of Final Tract Map No. 12273 subject to the final approval
of the City Engineer.

PROJECT ANALYSIS:
The applicant recently purchased the southerly property from the Federal
Government and obtained a building permit to construct a 12,160 square foot
addition to an existing business which manufactures swimming suits. One of the
conditions of the building permit was that a parcel map would have to tie the
two parcels together. The proposed map is in conformance with the Tustin Area
General Plan and the Planned Community District Regulations for the Tustin
Irvine Industrial Complex. The condi*tions of approval are listed in Resolution
No. 2280.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, RECOMMENDING APPROVAL OF TENTATIVE
PARCEL MAP 85-391 LOCATED AT 2712 DOW AVENUE
The Planning Commission of the city of Tustin does hereby resolve as
follows:
I. The Planning Commission finds and determines as follows:
That Tentative Parcel Map No. 85-391 was submitted to the
Planning Commission pursuant to Ordinance No. 847 by Raj
Manufacturing requesting authorization to create one parcel from
two parcels for the property known as Parcel 2, Lot A, Tract
8763 as recorded in Book 354, pp. 13-16 of miscellaneous maps of
Orange County and a parcel known as Lot 58 of Block 45 as
recorded in Book 354, pages 13-16 of miscellaneous maps of
Orange County.
B. That said map is in conformance with the Tustin Area General
Plan.
C. That the project is categortcal)y exempt from the requirements
of the California Environmental Quality Act; Class 15.

The applicant ts proposing a g,7g0 square foot retail shopping center at the
southeasterly corner of Newport and Walnut Street. The proposed map of .75

The Planning Commission of the city of Tusttn does hereby resolve as

I. The Planning Commission finds and determines as follows:

That Tentative Parcel Map No. 85-362 was submitted to the
Planning 'Commission' pursuant to Ordinance No.' 847'by Metro
Engineering requesting authorization to create one parcel from
four existing parcels for the property known as Lots g, 10, 11,
12 in Block B of Martin's Addition as recorded in Book 19, page
79 of miscellaneous records of Los Angeles County, California.

A site grading plan should be required depicting all proposed finish
elevations within the site as well as all existing elevations of adjacent
properties. This grading plan should be based upon datum from benchmarks
as provided by the Orange County Surveyor's Office.
A civil site plan/street improvement plan and profile, if needed, showing
all proposed improvements within the public right-of-way and referenced
with all applicable city standard drawings. Improvements will include but
not be limited to the following:
a. Street paving
b. Curb and gutter
c. Sidewalk
d. Driveway aprons
e. Street lights with underground conduit
f. · Street trees
All on-street parking along Newport Avenue frontage will be prohibited as a
part of a long range plan to provide three travel lanes in each direction
along Newport Avenue.
Orange County Sanitation District No. 7 sewer connection fees will be
required at the time a building permit is issued. The fee is based upon
$50.00 per 1,000 sq. ft. of building area less any previously paid
residential fee and any applicable front footage charges for connection
directly to a County Sanitation District line.
East Orange County Water Disrict fees will be required at the time a
building permit is issued. Contact Earl Rowenhorst at Tustin Water Service
for fee amounts.
In the event the city has established an Eastern Corridor Fee Program at
the time a building permit is issued, this development will be required to
pay the established fees.
All landscaping in the public right-of-way shall be maintained by the
property owner.

On October 23, 1985, D.G. Associates applied for a sign permit to install a neon
wall and monument sign for Fiddlers Three Restaurant. As shown on the attached
plans, the monument sign has been rev.ised using a red and white plexiglass face
instead of exposed neon.
Prior to approval and issuance of the appropriate permits, the signs were
installed. The wall sign consists of an off-white background with red neon
tubing all of which is covered with a clear plexiglass face. Section 9444i
requires that exposed neon tubing may be used as part of an approved design
feature.

ANALYSIS AND CONCLUSIONS:
Unfortunately, the wall sign was installed prior to permit issuance. However,
the installation has allowed staff to analyze the appropriateness of neon
signing at this location. Currently, Fiddler's Three has three signs posted:
(1) plexiglass monument as shown on the attached plans; (2) a wooden
sandblasted wall sign near the front entrance; (3) and the neon wall sign shown
on the plans. None of these signs are of the same type, but they do incorporate
the use of similar colors
The overall effect of the neon sign is that of an indiscriminately placed,
brightly lighted neon sign. This sign is so different from the other signs that
it could not be considered as part of an integrated design feature and should
not be allowed.
