BACKGROUND: On November 5, 1985 the Orange County Board of Supervisors adopted a hazardous materials disclosure ordinance to be implemente~ within all of unincorporated Orange County. This ordinance, designed to be a model ordinance, addresses all major areas of concern revolving around the handling and storage of hazardous substances. Specifically, types and quantities of materials to be disclosed are specified as well as procedures protecting legitimate trade secrets. The ordinance as adopted is endorsed by the Orange County Fire Chief's Association and was prepared with the cooperation of: the County Administrator's Office; the Energy and Environment Committee of the Chamber of Commerce; a private industry group called the Industrial Environmental Coalition; and the City of Irvine's Hazardous Marterials Program Advisor. In addition to the Board's recent action, Assembly Bill 2185 was adopted by the Legislature. AB2185 will require that every county, or individual city, administer a program that would cause "...any business which handles a hazardous material to annually submit a specified inventory to the administering agency." Therefore, businesses within the city will have to disclose certain information, the only question will be to which jurisdiction the information be transmitted. DISCUSSION: Although the County formally adopted the model disclosure ordinance, the Board of Supervisors has given County staff 60 days to prepare a precise implementation program detailing fees, inspection programs, and enforcement activities. However, it is anticipated that the City will receive drafts of the implementation plan within the next few weeks. Presently staff is reviewing the ordinance adopted by the County. Upon completion of that review and after an analysis of the implementation program, specific recommendations on how the city should proceed in this area will_be forwarded to the Council for consideration. /XF~¥~/~ ~ UAVI~ ///~(fciate Planner
