ORDINANCE NO. 956 - AN URGENCY ORDINANCE REPEALING THE DEVELOPMENT
MORATORIU~ ON FIRST STREET
RECOMMENDED ACTION:
It is recommended that Urgency Ordinance No. 956 be adopted repealing the
development moratorium in effect on First Street. A four fifths {4/5) vote of
the Council is required to lift the moratorium.

DISCUSSION:
Since June 3, 1985, there has been a development moratorium prohibiting any new
development on properties located on First Street between Newport Avenue and the
Costa Mesa Freeway. This restriction on development was imposed in conjunction
with the preparation of a Specific Plan for the First Street corridor.
At this time, the development of the Specific Plan is to the point where land
use and design guidelines have been determined and any new project could be
reviewed under these standards. Accordi6gly, even though the final plan has yet
to be adopted, it is considered an appropriate time to lift the development
moratorium on First Street.

ORDINANCE NO. 956
AN URGENCY ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF TUSTIN, CALIFORNIA· REPEALING
ORDINANCE NO. 936 WHICH ESTABLISHED A DEVELOPMENT
MORATORIUM ON FIRST STREET.
The City Council of the city of Tustin, California, does ordain as follows:
I. The City Council finds and determines as follows:
That the First Street Specific Plan has been developed to the
point that specific land use and design guidelines can be
applied to any new development proposals submitted for First
Street.
B. That the moratorium on development established by Ordinance No.
936 should be repealed.
II.
The City Council hereby repeals Ordinance No. 936. This Ordinance
is adopted to protect the public health, safety and welfare and is
adopted as an urgency measure by a four fifths (4/5) vote pursuant to
the provisions of Sectionn 65858 of the California Government Code
and shall take effect immediately.
'The urgency is based on the fact that the First Street Specific Plan
has been prepared to the point that guidelines can be applied to any
proposed developments along First Street. To further delay
development processing places an undue economic hardship upon
property owners in the area.
PASSED AND ADOPTED as an urgency ordinance at a regular meeting of the City
Council of the City of Tustin held on the day of
· 1985.
