SIGN CODE EXCEPTION FOR BURNETT EHLINE PHASE I PROJECT

RECOMMENDED ACTION:
It is recommended that the Council, by minute order, grant sign code exception
authorizing a 12 square foot wall sign for Allstate Insurance at 18302 Irvine
Blvd.
SUI~ARY:
As an original condition of approval for the project constructed on the
southeast corner of Irvtne Blvd. and Holt Avenue, a master sign plan was
required. A plan has been submitted and meets the criteria and intent of the
Tustin sign ordinance with one exception. Allstate Insurance Co. is requesting
a sign which is six square feet larger than permitted under a strict
interpretation of the sign code. However, since the site and proposed signage
meet requirements for a sign code exception, the additional square footage can
be authorized by Council.
ANALYSIS:
Pursuant to Section 9740 of the sign code, Council may, under certain
circumstances, grant an exception to sign regulations. Such an exception may be
granted when any of the following conditions exist:
1. Subject property* is developed with structural setback more than two times
the minimum front setback requirement of the district.
2. Subject property frontage is at least 75% of the minimum frontage
requirements for like signing.
Proposed signing does not exceed more than one in number nor more than 15%
in area of the aggregate size of signs authorized by the criteria of the
district.
4. The proposed signing would be in subtantial conformance with the purposes
and intent of the sign code.
As developed, the project meets criteria I and 2 and the sign proposed is
otherwise allowed. Further, the property owner is willing to forego any
free-standing signs for the project, therefore an additional six square feet for
Allstate will not exceed aggregate sign area permitted for the site.
Accordingly, if the Council approves the requested sign, a condition prohibiting
free-standing signing should be imposed.

CONCLUSION:
If the Council concurs that the Allstate sign shown on Exhibit A attached meets
the intent of sign code provisions, the sign should be approved subject to the
following conditions:
That as long as the Allstate sign exceeds six square feet, there shall not
be permitted any free-standing signing for the project complex.
That other tenant signing not shown on the master sign plan (Exhibit A)
will be restricted to a directory sign not visible from the public
right-of-way.
This action can be taken by minute order of the Council.
