THAT COUNCIL WAIVE THE REQUIRF.~IENT FOR A TEN FOOT (10') IRREVOCABLE OFFER OF DEDICATION AS REQUIRED BY USE PERMIT NO. 85-28 RECOI~ENDED ACTION: Pleasure of the Council. SUI~IARY: On December 16, 1985 an appeal was filed by Mr. George Hillyard on behalf of the Mobil Oil Company. This appeal was filed in opposition to condition no. 2 of the Conditions of Approval on Use Permit No. 85-28 as approved by the Planning Commission. ANALYSIS: Condition No. 2 on Use Permit No. 85-28 requires a ten {10) foot irrevocable offer of dedication along Irvine Blvd. This condition, as required by the Engineering Department, is requested in conformance with the Tustin Master Plan of Arterial Highways. The City Engineer will be available during this public hearing questions regarding this appeal. GEORGE HILLYARD ON BEHALF OF MOBIL OIL CORPORATION, TO INSTALL A MINI-MARKET AT 172411RVINE BOULEVARD. The Planning Commission of the City of Tustin does hereby resolve as follows: The Planning Commission finds and determines as follows: That a proper application, (Use Permit No. 85-28) has been filed by Mr. George Hillyard on behalf of Mobil Oil Corporation to authorize the installation of a mini-market in an existing 167 square foot sales area at 172411rvine Boulevard, in conjunction with a retail gasoline and automotive service station. That a public hearing was duly called, noticed and held on said application. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working ~n the neighborhood of Such proposed use, evidenced by the following findings: The use is in conformance with the Tustin Area General Plan and with use and application proceedures of the Zoning Code (Section 9232b). That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin as evidenced by compliance with the City's Zoning and Development standards. Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Orange County Fire Marshal and street improvement requirements as administered by the City Engineer. Fo That the project is categorically exempt from the requirements of the California Environmental Quality Act as specified in Section t5303c. II. Any missing or damaged pUblic improvements shall be installed or replaced. ® Provide an irrevocable offer of dedication of ten {10) feet along Irvine Boulevard. Final development plans shall require the review and approval of the Co~antty Development Department. The provisions of the Use Permit do not include authorization for'the sale of alcoholic beverages. Prior to conversion to the mini-market, a sign plan shall be submitted and approved by the Community Development Department. Approval of Use. Permit 85-28 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form asestabltshed by the director of Community Development.
