HomeMy WebLinkAboutCC 10 USE PERMIT 85-28 01-20-86 1 2 5 I. 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 20 21 24 25 26 28 CONSENT CALENDAR NO. 10 1-20-86 RESOLUTION NO. 86-6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, WAIVING THE REQUIREMENT OF A TEN FOOT IRREVOCABLE OFFER OF DEDICATION_. ALONG IRVINE BOULEVARD FOR THE PROJECT APPROVED BY USE PERMIT 85-28 AT 17241 IRVINE BOULEVARD. The City Council does hereby resolve as follows; That a proper application (Use Permit No. 85-28) has been filed by Mr. George Hillyard on behalf of Mobil Oil Corporation requesting authorization to install a mini market in an existing 167 sq. ft. area in the service station located at 17241 Irvine Boulevard. That a public hearing was duly called, noticed and held by the Planning Commission of the City of' Tustin, on December 9, 1985 on said application. Ce The Planning Commission approved Use Permit 85-28 by the adoption of Resolution No. 2287 which authorized the installation of a. 167 square foot mini market within the existing sales area at 17241 Irvine Boulevard as applied for, subject to the following conditions: 1. Any missing or damaged public improvements shall be installed or. replaced. Provide an irrevocable offer of dedication of ten (10') feet along Irvine Boulevard. 3. Final development plans shall require the review and approval of the Community Development Department. 4. The provisions of the Use Permit do not cover the authorization for the sale o'f alcoholic beverages. Prior to conversion to the mini market, a sign plan shall be submitted to and approved by the Community Development Department. Approval of Use Permit 85-28 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the director of Community Development. On December 16, 1985 the applicant filed an appeal of the Conditions of Approval for Use Permit 85-28 to the Tustin City Council. 6 7 8 9 10 11 12 13 14 15 16 17 18 19' 2O 21 22 23 24 27 28 Resolution No. 86-6 Page two A public hearing before the City Council was duly called, noticed and held on said appeal. II. The City Council hereby upholds Planning Commission approval of Use Permit 85-28 with the following amendment: Condition No. II. A. 2 of Planning Commission Resolution Number 2287 pertaining to an irrevocable offer of dedication of ten {10') feet along Irvine Boulevard is hereby deleted.
