INTERCHANGE MODIFICATION
RECOMMENDATION:
That the Tustin City Council, at their meeting of February 3, 1986, authorize the
Mayor to execute the attached Freeway Agreement for Stage I work of the I-5/Rte.
55 Interchange Modification Project subject to final approval by the City
Attorney's office.
BACKGROUND:
CalTrans is planning the complete modification of the I-5/Rte. 55 Freeway
Interchange along with widening of both freeways within the immediate vicinity of
the interchange. The work is proposed to be completed in a three-stage program as
follows:
Stage I Construction - Late 1987 through late 1989.
Stage II Construction - Late 1989 through late 1992.
Stage III Construction - Unscheduled.
The Stage I work program is shown on Exhibit A of the attached Freeway Agreement
and generally consists of the following work items:
o Widening and reconstruction of the Warner Avenue overcrossing of the Costa
Mesa Freeway.
o Widening and reconstruction of the McFadden Avenue overcrossing of the
Costa Mesa Freeway.
Relocation of the southbound off/on-ramps of the Costa Mesa Freeway from
northerly of McFadden Avenue to southerly of McFadden Avenue.
° Alteration of northbound Rte. 55 off/on-ramps at Edinger Street and
McFadden Avenue.
The work programs for Stage II and III have not been definitely defined by
CalTrans as of this date.

DISCUSSION:
The attached Freeway Agreement provides for the following:
Supersedes previously executed agreements relating to those sections of
the Rte. 55 Freeway within Stage I construction.
City consents to all construction affecting City streets as delineated on
Exhibit A of the agreement.
° State shall acquire all required right of way necessary for said
construction.
City will accept control and maintenance over each of the relocated or
reconstructed City roads at completion of the Stage I work.
The City Attorney's office is currently reviewing these agreements and it is
requested that any City Council action be subject to the City Attorney's final
approval.

FREEWAY AGREEMENT
THIS AGREEMENT, made and entered into on this day of
· 19 , by and between the STATE OF CALIFORNIA, acting by
and through the Degartment of Transportation (herein referred to as
"STATE'), and the CITY OF TUSTIN (herein referred to as
WITNESSETH=
WHEREAS, the Highway described above has been declared to be
a freewaY by Resolution of the California Transportation Commission
on March 17, 1954; and
WHEREAS, STATE and County of Orange have entered into Freeway
Agreements relating to previous unincorporated areas that were
subsequently annexed by CITY as follows: an Agreement dated
February 16, 1960, relating to that portion of State Highway Route 55
from 0.2 mile south of Warner Avenue (formerly Delhi Road) to
McFadden Street; an Agreement dated September 22, 1958 relating to
that portion of State Highway Route 55 from McFadden Street to State
Highway Route 91; and
NOW, THEREFORE, IT IS AGREED=
1. ThiS Agreement supersedes in its entirety insofar as it
applies to CITY. said Freeway Agreement with County of Orange dated
February 16, 1960.
2. This Agreement supersedes insofar as it applies to CITY
that portion of saia Freeway Agreement dated September 22, 1958 from
McFadden Street to 0.2 miles north of McFadden Street.
3. CITY agrees and consents to the .... = ... C~ '~--~ ,
relocation of CITY streets, construction of frontage roads and other
local roa~s, and other construction affecting CITY streets, all as
shown on said plan -~p attached hereto marked Exhibit A and made a
part hereof'by this referens~.
4. STATE shall, in construction of the freeway and at
STATE's expense, make such changes affecting CITY streets in
accordance with the plan ,~p attached hereto marked Exhibit A.
5. STATE agrees to acquire all necessary right-of-way as
may be required for construction, reconstruction, or alteration of
CITY streets, frontage roads, and other local roads, and CITY hereby
authorizes STATE to acquire in its behalf all such necessary
right-of-way.
6. It is understood between the parties that the
right-of-way be acquired in sections or units, and that both as to
the acquisition- of right-of-way and the construction of the freeway
projects, the obligations of STATE hereunder shall be carried out at
-such time and for such unit or units of the project as funds are
budgeted and made lawfully available for such expenditures.
7. CITY will accept control and maintenance over each of
the relocated or reconstructed CITY roads, and the frontage roads,
and other STATE constructed local roads on receipt of written notice
to CITY from STATE that the work thereon has been completed, except
for any portion which is adopted by STATE as a part of the freeway
proper. CITY will accept title to the portions of such roads lying
outside the freeway limits, upon relinquishment by STATE.
8. This Agreement may be modified at any time by the mutual
consent of the parties hereto, as may become necessary for the best
accomplishment, through STATE and CITY cooperation, of the whole
freeway project for the benefit of the people of the STATE and of the
CITY.

IN WITNESS WHEREOF, the parties hereto have caused this
Agreement-to be executed by their respective duly authorized
officers.
