FEDERAL AID URBAN (F.A.U.) PROJECT
RECOMMENDATION:
That the Tustin City Council, at their meeting of February 18, 1986, approve
Program Supplement No. 7 to Local Agency Agreement No. 7 to Local Agency Agreement
No. 07-521 covering the installation and modification of traffic signals and
interconnect on Newport Avenue from E1Camino Real to Sycamore Avenue.
BACKGROUND:
The City has an approved Federal Aid Urban (F.A.U.) project for the installation
and modification of traffic signals and interconnect on Newport Avenue from E1
Camino Real southerly to Sycamore Avenue.
This program provides for 86% funding by Federal sources and 14% funding by local
agency.
DISCUSSION:
The attached agreement is Supplement No. 7 to Local Agency-State Agreement No.
07-5271. The original master agreement was approved by both agencies in October,
1979. Each time a new project is committed to by CalTrans/Federal Highway Works
Administration (F.H.W.A.) a program supplement must be executed by CalTrans and
the local agency. This type of supplemental agreement has been previously
executed by the City for six previous projects which have been completed.
The provisions of this agreement are outlined on page 2 of the supplement
document.
Funding and cost breakdown for this project is as follows:

The City originally budgeted a total of $32,800 for this project.
The execution of this Program Supplement No. 6 will require the adoption of a
minute order authorizing said execution.

the installation and modification of traffic signals and inter-
connect on Newport Avenue from Main Street to Sycamore Avenue.
Please return both the original and the copy of Supplemental
Agreement No. 7, executed on the part of the City, with a copy
of the certified authorizing council action attached to each.
After execution of the agreement by the State, a fully executed
copy of the agreement will be returned for your file.
The date of execution by the City should be typed in the space
provided on the first page of the agreement.

This Program Supplement is hereby incorporated into the Local Agency-State Agreement
for Federal-Aid which was entered into between the LOCAL AGENCY and the STATE on
10-'15-79 and ia subject to all the terms and conditions thereof. This Program
Supplement is adopted in accordance with Paragraph 2 of Article II of the aforementioned
Master Agreement under authority of Resolution No. ,approved by the
LOCAL AGENCY on (See copy attached).
The Local Agency further stipulates that as a condition to payment of funds obligated to this project,
it accepts and will comply with the convenants or remarks set forth on the following pages.
PROJECT LOCATION: In the City of Tustin, Orange County, on Newport
Avenue from Main Street to Sycamore Avenue.

Ail maintenance, involving the physical condition and the
operation of the improvements, referred to in Article VI
MAINTENANCE of the aforementioned Master Agreement will be
performed by the City of Tustin at regular intervals or
as required for efficient operation of the completed
improvements.
The City of Tustin will advertise, award and administer
this project. The City will obtain State's concurrence
prior to either award or rejection of contract.
In awarding, or agreeing to award the contract, the Local
Agency agrees the payment of Federal funds will be limited
to the Detail Estimate amount approved by the Federal
Highway Administration in the Federal-Aid Project Agreement
(~R-2), or its modification (PR-2A), and accepts any increases
in Local Agency funds.
The availability of Federal funds will be subject to meeting
deadlines and/or other conditions as may be imposed by the
Director upon the recommendation of the FAU Advisory
Committee.
In executing this Program Supplemental Agreement, Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for
Federal-Aid Program.
