HomeMy WebLinkAboutCC 4 FREEWAY AGREE'S 03-17-86  CONSENT CALENDAR AGENDA Inter Corn TO: FROM: SUBJECT: WILLIAM HUSTON, CITY MANAGER BOB LEDENDECKER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER FREEWAY AGREEMENTS'FOR MYFORD ROAD INTERCHANGE IMPROVEMENTS RECOMMENDATION: That the Tusttn City Council, at their meeting of March 17, 1986, authorize the Mayor to execute the attached Freeway Agreement for the I-5/Myford Road Interchange Modification Project. BACKGROUND: CalTrans is planning the complete modification of the I-5/Myford Road interchange to provide for a full movement partial cloverleaf facility. The following is a recap of events that have occurred to date and a tentative schedule of upcoming items: Request for project approval to CalTrans-Sacramento ....... Dec., 1985 Environment assessment certification ...................... Feb., 1986 Plans and specifications to CalTrans-Sacramento for approval ................................................ Jan., 1987 Advertise bids Nov., 1987 Complete construction ..................................... Late 1988 DISCUSSION: The attached Freeway Agreement provides for the following: ° Supercedes previously executed agreements related to that section of the I-5 Freeway as described from Myford Road to 0.$ mile north of Myford Road. ° City consents to all construction affecting City streets as delineated on Exhibit "A" of the agreement. ° State shall acquire all right of way necessary for said construction. ° City will accept control over each of the relocated or reconstructed City roads at the completion of the proposed work. Director of Public Works/City Engineer BL:jr Attachment FREEWAY AGREEMENT 7-ORA-5 27.6/28.1 In the City of Tustin Between Myford Rd and 0.5 Mi N/O Myford Rd THIS AGREEMENT, made and entered into on this day of ,19 , by and between the STATE OF CALIFORNIA, acting by and through the Department of Transportation (herein referred to as "STATE"), and the City of Tustin (herein referred to as "CITY"), WITNESSETH: WHEREAS, the highway described above has been declared to be a freeway by Resolution of the California Highway Commission on July 15, 1952; and WHEREAS, STATE and County of Orange have entered into a Freeway Agreement dated January 13, 1959, relating to that portion of State Highway Route 5 from Niguel Road (El Toro Road) to the Santa Ana City limit near First Street; and WHEREAS, a revised plan map for such freeway has been prepared showing the proposed plan of the STATE as it affects streets of the CITY; and WHEREAS, it is the mutual desire of the parties hereto to enter into a new Freeway Agreement in accordance with the revised plan of said freeway; NOW, THEREFORE IT IS AGREED 1. This Agreement supersedes that portion of said Freeway Agreement dated January 13, 1959 from Myford Road to 0.5 mile north of Myford Road. 2. CITY agrees and consents to the closing of streets, relocation of CITY streets, construction of frontage roads and other local roads, and other construction affecting CITY streets, all as shown on said plan map attached hereto marked Exhibit A and made a par~ hereof by this reference. 3'. STATE shall, in construction of the freeway will, at STATE'S expense, make such changes affecting CITY streets in accordance with the plan map attached hereto marked Exhibit A. 4. The STATE agrees to acquire all necessary right-of-way as may be required for construction, reconstruction or alteration of CITY roads, frontage roads and other local roads, and the CITY, hereby authorizes the STATE to acquire in its behalf all such necessary right-of-way. 5. It is understood between the parties that the right-of- way may be acquired in sectiOns or units, and that both as to the acquisition of right-of-way and the construction of the freeway projects, the obligations of STATE hereunder shall be carried out at such time and for such unit or units of the project as funds are budgeted and made lawfully available for such expenditures. 6. CITY will accept control and maintenance over each of the relocated or'reconstructed CITY streets, and the frontage roads, and other STATE constructed local roads on receipt of written notice to CITY from STATE that the work thereon has been completed, except for any portion which is adopted by STATE as a part of the freeway proper. CITY will also accept title to the portions of such roads lying outside the freeway limits, upon relinquishment by STATE. 7. This Agreement may be modified at any time by the mutual consent of the parties hereto, as may become necessary for the best accomplishment, through STATE and CITY cooperation, of the whole freeway project for the benefit of the people of the STATE and of the CITY; IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by their respective duly authorized officers.
