HomeMy WebLinkAboutCC 8 COOP AG'S 03-17-86DATE: MARCH 7, 1986 TO: FROM: SUBJECT: WILLIAM HUSTON, CITY MANAGER BOB LEDENDECKER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER COOPERATIVE AGREEMENTS D86-02 AND D86-031 RECOMMENDED ACTION: That the Tustin City Council, at their meeting of March 17, 1986, authorize the Mayor to execute Agreement D86-02 and D86-031 on behalf of the City and authorize a supplemental budget appropriation within the Water Enterprise fund in the amount of $11,500.00 to fund said work under these agreements. BACKGROUND: The County of Orange Environmental Management Agency will be awarding contracts for the "Resurfacing of. Various Streets" within the unincorporated area adjacent to the City of Tustin. The Tustin Water Service has various mainline distribution facilities within the street rights of way where the County road work will be performed. The Water Service facilities are located within the County streets under franchise regulations, wherein the utility company is responsible for any work related to its own facilities. In order to adjust the water valve boxes to the new street grades under the street resurfacing contracts, the County has requested the City to enter into an agreement which has provisions for the City to reimburse the County for said work. The adjustment of the water valve boxes to finish street grade is required so that full-time access is available by the City.to the mainline gate valves in the event a routine or emergency, shutdown of. the water lines is required. DISCUSSION: The attached agreements D86-02 and D86-031 pertain to two separate County street resurfacing projects. Each agreement covers a specified number of valve boxes .to be adjusted to final grade as follows: Agreement Quantity of Valve Boxes Estimated to be Adjusted Cost D-86-02 43 Each $ 8,325.00 D-86-031 16 Each 3,098.00 $11,423.00 The final cost of this work will be computed on actual bid prices resulting from the County's competitive bidding procedures for Public Works projects. MARCH 7, 1986 PAGE 2 An alternative to including this work as a part of the County contracts, would be for City forces to perform this work. This is not practical to the Water Service, at this time, due to the current workload and staffing levels. Additionally, it is imperative that the gate valves be accessible at all times due to the potential need for emegency system shut-downs. The execution of these agreements will require a supplemental budget appropriation in the Water Enterprise fund in the amount of $11,500.00. RECITALS WHEREAS, COUNTY is preparing to contract for "Resurfacing of Various Streets. In Orange County 1985-86 (Contract No. 1)," hereinafter referred to as PROJECT, which consists primarily of resurfacing or reconstructing existing streets, some of which lie within OWNER's service area; and WHEREAS, OWNER maintains a water system, including valves, within the area of COUNTY's PROJECT and PROJECT will require valve box adjustment to the new street grade; and WHEREAS, OWNER desires COUNTY to perform the adjustment of approximately 43 valve boxes (at an estimated cost of $176 each) as part of COUNTY's PROJECT; and WHEREAS, COUNTY is willing to include this valve box adjustment in its PROJECT at OWNER's cost. NOW, THEREFORE, the parties hereto agree as follows: 1. OWNER shall deposit with COUNTY"s Environmental Management Agency $7,568 as the estimated cost for said valve box adjustment. Said deposit shall be made within 30 days of receipt of this executed agreement. 2. OWNER, prior to commencement of said PROJECT, shall place a paint mark on the curb opposite each valve box and indicate distance from curb face to center of valve box to facilitate subsequent locating and adjusting valve boxes by COUNTY. COUNTY shall include in PROJECT contract documents "Adjust Water Valve Box" as a bid item and, through its contractor, shall adjust said water valve boxes to grade in. accordance with PROJECT contract documents based upon the Standard Specifications for Public Works Construction, 1982 edition. 4. OWNER shall pay the total cost for adjusting said water valve boxes to grade. Said total cost will be determined by multiplying the unit price by the total number of valve boxes adjusted, plus 10% for COUNTY inspection and administration. HOWEVER, to protect OWNER and COUNTY from unbalanced bids, regardless of the bid amount, OWNER shall be responsible for a unit price not to exceed $160, but not less than $125. If extra work is required, its cost will be added to said total cost, but extra work will only be performed after prior approval by OWNER's engineer or manager. 5. COUNTY shall, upon completion of said PROJECT, prepare and submit to OWNER a state- ment of the final cost authorized by this agreement, which statement will include total number of valve boxes adjusted, unit price, 10% inspection and administration amount, and extra work, if any.
