SOUTHERN PACIFIC PIPE LINE RELOCATION
RECOMMENDATION:
That the Tustin City Council, at their meeting of April 21, 1986, pass and adopt
the attached Resolution consenting to and providing terms and conditions for
relocation of certain pipelines within the public right-of-way.
BACKGROUND:
On March 17, 1986, the Tustin City Council adopted Resolution No. 86-40 consenting
to and providing terms and conditions for relocation of certain pipelines within
the public right-of-way. The company referenced to in Resolution No. 86-40 was
the Southern Pacific Pipe Line Company.
All references (business cards, letterheads, etc.) and dealings have been with the
Southern Pacific Pipe Line Co. (S.P.P.L. Co.). However, the facility to be
relocated is operated under the name of San Diego Pipe Line Co. (S.D.P.L. Co.).
The original Resolution No. 86-40 was prepared with the company name referenced as
Southern Pacific Pipe Line Co. in lieu of the San Diego Pipe Line Co.
DISCUSSION:
The attached Resolution corrects the name reference from Southern Pacific Pipe
Line Co. to the correct vesting of San Diego Pipe Line Co. All other verbage of
the Resolution remains the same.
A copy of the previous staff report and Resolution No. 86-40 is attached for the
City Council's information.
It is requested that the attached Resolution be passed and adopted to correct the
improper company name designation utilized in Resolution No. 86-40.

A RESOLUTION OF TIiE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, CONSENTING
TO AND PROVIDING TERMS AND CONDITIONS
FOR RELOCATION OF CERTAIN PIPELINES
WITHIN THE PUBLIC RIGHT-OF-WAY.
The City Council of the City of Tustin, California,
hereby resolves as follows:
1. The City Council finds and determines as follows:
A. San Diego Pipe Line Company has a ten inch (10")
refined products pipeline presently located primarily in pri-
vate property owned by The Irvine Company; and
B. The Irvine Company is in the process of develop-
ing its property, in parts of which the said pipeline is
located; and
C. The Irvine Company wishes to have the said
pipeline relocated into the public right-of-way of Browning
Avenue and San Diego Pipe Line Company is agreeable to such
relocation provided that it receives certain consents and
certain assurances from the City of Tustin; and
D. The City of Tustin is willing to consent to
the relocation of said pipeline and the installation and
maintenance of an additional refined products pipeline, to-
wit, a sixteen inch (16") pipeline, within the public right-
of-way of Browning Avenue and is willing to provide certain
assurances to San Diego Pipe Line Company concerning said

2. The City Council of the City of Tustin hereby
consents to the relocation of the ten inch (10") pipeline and
the placement of a sixteen inch (16") pipeline of San Diego
Pipe Line Company into the public right-of-way of Browning
Avenue, between stations 1258+22 and 1264+53, as shown on the
drawing attached hereto, marked Exhibit "A", subject to the
approval of the Director of Public Works of the City of Tustin
as to the precise location, plans, specifications, and method
of installation of said pipelines.
3. The City Council of the City of Tustin hereby
agrees and prescribes that it will not require the further
relocation of said pipelines, either vertically and/or hori-
zontally, except under circumstances where relocation of

either or both of said pipelines is required by circumstances
which necessitate the installation or relocation of other
public utility facilities.
PASSSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California, held on the
day of May, 1985.

RECOMMENDATION:
That the Tusttn City Council, at their ,meting of March 17, 1986, pass and adopt
the attached Resolution which indicates the City's willingness to pursue all
avenues that would prevent the need for the relocation of the Southern Pacific
Pipe Line Company facilities within Browning Avenue.
BACKGROUND:
As a result of the abandonment oR the A.T. & S.F. Ratlroad facility easterly of
Browning Avenue and northerly of the Santa Aha Freeway, and the East Tusttn
deve!opment, it fs necessary for The Irvfne Company to relocate the existing 10'
fuel line of the Southern Pacific Pipe Line Company (5.P.P.L.) to the vicinity of
Browning Avenue.
The S.P.P.L. Co. currently holds a prior right easement which requires The Irvtne
Company to bear all costs for said relocation as well as provide a new easement
for said facility. It is proposed to relocate this facility adjacent to and
outside of the ppbltc right of way along Browning Avenue except for the area
adjacent to the Edison Company substation at Bryan and Browning Avenues. The area
adjacent to the substation will require location of the facility within the
Browning Avenue right of way.
DISCUSSION:.
Staff has indicated to The Irvine Company and S.P.P.L. Co. that a prior right
easement within a public r~ght of way can not be granted to an individual
company for placement of their facilities. The $.P.P.L. Co. has requested that
the City pass and adopt a Resolution that states that the City will pursue all
avenues to prevent the need of any relocation of their facilities within the
public right of way of Browning Avenue adjacent to the Edison Company substation.
Thst would be done normally as a part of the City's routine operation.
The City Attorney's office has prepared the attached Resolution which staff feels
answers S.P.P.L. C~mpany's request and falls within the routine operations and
obligations of the City.
