HomeMy WebLinkAboutCC 8 UNDERGD UTIL 7 05-05-86 · CONSENT CALENDAR f NO, 8 · , · ,, TO: FROM: SUBJECT: WILLIAm! ltUSTON, CITY NANAGER PUBLIC WORKS DEPARTmENT/ENGINEERING DIVISION NEWPORT AVENUE UNDERGROUND UTILITY DISTRICT NO. 7 RECOMMENDATION: That the Tustin City Council, at their meeting of May 5, 1986, pass and adopt the attached Resolution which sets the time and place of a public hearing to consider the designation and adoption of the Newport Avenue Underground Utility District No. 7. BACKGROUND: The proposed Underground Utility District No. 7 provides for the conversion of all overhead utilities to underground facilities along Newport Avenue between 325 feet northerly of Bryan Avenue and Wass Street. This section of underground work is the last segment of existing overhead utilities along Newport AVenue and its completion will result in all of Newport Avenue being undergrounded between the Santa Ana Freeway to a point northerly of Seventeenth Street in the unincorporated County area. DISCUSSION: City of Tustin Ordinance No. 411 authorizes the City Council from time to time to call public hearings to ascertain whether the public necessity, health, safety or welfare require the removal of poles, overhead wires, etc. within certain designated areas of the City and, to consider the underground installation of the abovementioned appurtenances for supplying electric, communication or other similar services. Ordinance No. 411 also requires the City to notify all affected property owners and all concerned utilities by mail of the time and place of said hearings to determine whether to form an Underground Utility District at least ten (10) days prior to the date of said public hearing. The attached Resolution sets the date of public hearing for Underg?ound Utility District No. 7 on Monday, June 2, 1986, at 7:00 p.m. in the City Council Chambers, 300 Centennial Way. April 28, 1986 Page Two Underground Utility District No. 7 is proposed to be administered by Edison Company Rule 20A funding except for the installation of fourteen additional street lights. A complete cost breakdown of this proposed project will be included within the City Engineer's report for said District No. 7 which will be available at least ten days prior to the public hearing date of June 2, 1986. The formation of this Underground Utility District will require the conversion of utility services for three property owners outside of the proposed District boundaries from overhead to underground. It is proposed to fund these conversions with either City or Redevelopment Agency funds. Concurrent with this Underground Utility District an Edison Company Rule 20B Underground Utility District will be processed as District No. 8. This District No. 8 will cover the portions of Holt Avenue between Newport Avenue and Irvine Blvd., and Irvine Blvd. between Holt Avenue and Newport Avenue. Director of Public Works/City Engineer BL:jr Attachment 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO, 86-58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN SETTING A TIME AND PLACE OF A PUBLIC HEARING TO CONSIDER THE DESIGNATION AND ADOPTION OF AN UNDERGROUND UTILITY DISTRICT REQUIRING THE REMOVAL OF POLES, OVERHEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES WITHIN THE AREA OF THE CITY OF TUSTIN LOCATED ON NEWPORT AVENUE BETWEEN 325 FEET NORTHERLY OF BRYAN AVENUE AND WASS STREET, WHICH AREA IS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" Al~FACHED HERETO AND ON THAT CERTAIN MAP ON FILE IN THE OFFICE OF THE CITY CLERK AND CITY ENGINEER OF THE CITY OF TUSTIN WHEREAS, Ordinance No. 411 of the City of Tustin authorizes the City Council from time to time to call public hearings to ascertain whether the public necessity, health, safety or welfare require the removal of poles, overhead wires and associated overhead structures within certain designated areas of the City and to consider the underground installation of the aforementioned appurtenances for supplying electric, communication, or similar associated services to the residents of the City of Tustin, and WHEREAS, by the aforementioned Ordinance No. 411, the City Clerk is required to notify all affected property owners, if any, as shown on the last equalized assessment roll and also to notify all concerned utilities by mail of the time and place of hearings to determine whether to form an Underground Utility District and of the availability of the City Engineer's report of the details of the District in the office of the City Clerk prior to said hearing, and WHEREAS, said notice is required to be given to the aforementioned property owners and concerned utilities at least ten {10) days prior to the date of the public hearing, and WHEREAS, the City Engineer has advised that this report is on file in the office of the City Clerk, and WHEREAS, the City Council has determined that a public hearing should be set on June 2, 1986, at the hour of 7:00 P.M. in the City Council Chambers at 300 Centennial Way in the City of Tustin. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said Council hereby sets Monday, June 2, 1986, at 7:00 P.M. in the City Council Chambers at 300 Centennial Way in the City of Tustin, California, as the time and place for a public hearing to ascertain whether the public necessity, health, safety or welfare require the removal of poles, overhead wires and associated overhead structures and the establishment of an Underground Utility District within the area of the City of Tustin generally located on Newport Avenue between 325 feet northerly of Bryan Avenue and Wass Street, certain maps on file in the office of the City Clerk and the City Engineer of the City of Tustin. 1 5 $ ? 9 10 11 12 1~, 1,5 16 17 18 19 20 21 22 27 28 BE IT FURTHER RESOLVED that the City Clerk is hereby authorized to notify all affected property owners, if any, as shown on the last equalized assessment roll and to also notify all utilities affected by this proposal by a notice through the United States mail of the time and place of said hearing, and of the availability of the City Engineer's report of the details of the District in the office of the City Clerk prior to said hearing, ten {lO) days prior to the date thereof.
