RECOMMENDATION:
That the Tustin City Council, at their meeting of May 5, lg86, pass and adopt the
attached Resolution which sets the time and place of a public hearing to consider
the designation and adoption of the Holt Avenue/Irvine Boulevard Underground
Utility District No. 8.
BACKGROUND:
The proposed Underground Utility District No. 8 provides for the conversion of all
overhead utilities to underground facilities along Holt Avenue between Newport
Avenue and Irvine Boulevard, and along Irvine Boulevard between Holt Avenue and
Newport Avenue. A portion of this District will be funded by the developer,
Burnett-Ehline, as a condition of approval of Tract No. 11829 at the southeasterly
corner of Holt Avenue and Irvine Boulevard. Additionally, this district will
complete the undergrounding of all utilities along Irvine Boulevard between Yorba
Street and Newport Avenue.
DISCUSSION:
City of Tustin Ordinance No. 411 authorizes the City Council from time to time to
call public hearings to ascertain whether the public necessity, health, safety or
welfare require the removal of poles, overhead wires, etc. within certain
designated areas of the City and, to consider the underground installation of the
abovementioned appurtenandes for supplying electric, communication or other
similar services.
Ordinance No. 411 also requires the City to notify all affected property owners
and all concerned utilities by mail of the time and place of said hearings to
determine whether to form an Underground Utility District at least ten (10) days
prior to the date of said public hearing.
The attached Resolution sets the date of public hearing for Underground Utility
District No. 7 on Monday, June 2, 1986, at 7:00 p.m. in the City Council Chambers,
300 Centennial Way.

Underground Utility District No. 8 is proposed to be administered by Edison
Company Rule 20B procedures where the local agency provides all of the conduit and
structure and Edison Company provides the conductors and equipment. The majority
of the funding is-by the local agency and minimal funding by the Edison Company.
The developer, Burnett-Ehline, will be participating in the major portion of the
City's share per previous conditions of approval of Tract No. 11829.
Additionally, a major portion of the required conduit along Holt Avenue and along
a portion of Irvine Boulevard was installed by the City at the time Tract No.
11829 was under development. A complete cost breakdown of this proposed project
will be included within the City Engineer's report for said District No. 8 which
will be available at least'ten days prior to the public hearing date of June 2,
1986. The formation of this Underground Utility District will require the
conversion of utility services for two property owners within the District. It is
proposed that these conversion costs will be borne by the property owner.
Concurrent with this Underground Utility District an Edison Company Rule 20A
Underground Utility District will be processed as District No. 7. This District
No. 7 will cover a portion of Newport Avenue between 325 + feet northerly of Bryan
Avenue and Wass Street. -

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
SE1-FING A TIME AND PLACE OF A PUBLIC HEARING TO CONSIDER
THE DESIGNATION AND ADOPTION OF AN UNDERGROUND UTILITY
DISTRICT REQUIRING THE REMOVAL OF POLES, OVERHEAD WIRES
AND ASSOCIATED OVERHEAD STRUCTURES WITHIN THE AREA OF THE
CITY OF TUSTIN LOCATED ON HOLT AVENUE BETWEEN NEWPORT AVENUE
AND IRVINE BOULEVARD, AND IRVINE BOULEVARD BETWEEN HOLT
AVENUE AND NEWPORT AVENUE WHICH AREA IS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A" A1-FACHED HERETO AND ON THAT CERTAIN
MAP ON FILE IN THE OFFICE OF THE CITY CLERK AND CITY ENGINEER
OF THE CITY OF TUSTIN
WHEREAS, Ordinance No. 411 of the City of Tusttn authorizes the City
Council from time to time to call public hearings to ascertain whether the
public necessity, health, safety or welfare require the removal of poles,
overhead wires and associated overhead structures within certain designated
areas of the City and to consider the underground installation of the
aforementioned appurtenances for supplying electric, communication, or similar
associated services to the residents of the City of Tustin, and
WHEREAS, by the aforementioned Ordinance No. 411, the City Clerk is
required to notify all affected property owners, if any, as shown on the last
equalized assessment roll and also to notify all concerned utilities by mail of
the time and place of hearings to determine whether to form an Underground
Utility District and of the availability of the City Engineer's report of the
details of the District in the office of the City Clerk prior to said hearing,
and
WHEREAS, said notice is required to be given to the aforementioned
property owners and concerned utilities at least ten {10) days prior to the
date of the public hearing, and
WHEREA. S, the City Engineer has advised that this report is on file in
the office of the City Clerk, and
WHEREAS, the City Council has determined that a public hearing should
be set on June 2, 1986, at the hour of 7:00 P.M. in the City Council Chambers
at 300 Centennial Way in the City of Tustin.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said Council hereby sets Monday, June 2, 1986, at 7:00 P.M. in the
City Council Chambers at 300 Centennial Way in the City of Tustin, California,
as the time and place for a public hearing to ascertain whether the public
necessity, health, safety or welfare require the removal of poles, overhead
wires and associated overhead structures and the establishment of an
Underground Utility District within the area of the City of Tustin generally
located on Holt Avenue between Newport Avenue and Irvine Boulevard between Holt
Avenue and Newport Avenue, certain maps on file in the office of the City Clerk
and the City Engineer of the City of Tustin.

BE IT FURTHER RESOLVED that the City Clerk is hereby authorized to
notify all affected property owners, if any, as shown on the last equalized
assessment roll and to also notify all utilities affected by this proposal by a
notice through the United States mail of the time and place of said hearing,
and of the availability of the City Engineer's report of the details of the
District in the office of the City Clerk prior to said hearing, ten (10) days
prior to the date thereof.
PASSED AND ADOPTED at a .regular meeting of the City Council of the
City of Tustin, California, on the 5th day of May, 1986.

described as follows:
Beginning at the point of intersection of the centerllnes of Irvine Boulevard
and Holt Avenue;
Thence, easterly along said centerline of Irvtne Boulevard a distance of
60.00 feet to a point;
Thence, northerly at right angles to said centerline a distance of 60.00 feet
to the point of intersection with a line parallel to and 60.00 feet northerly of,
as measured at right angles from, said centerline of Irvine Boulevard, said point
being on the westerly prolongation of the northerly right-of-way line of said
Irvine Boulevard.
Thence, easterly along said parallel line a distance of 557.5 feet more or
less to the southeasterly corner of Lot 2 of Tract No. 8475;
Thence, southerly along the easterly boundary of Tract No. 8475 a distance of
