RECOMMENDATION:'
For the City Council meeting of June 2, 1986.
Pass and adopt the attached Resolution to initiate proceedings for the annual
assessment levy after formation of a district pursuant to the provisions of the
~andscape and Lighting Act of 1972 and for the annexation of additional territory
to said existing district.
BACKGROUND:
In July, 1985, the City Council approved the formation of the Tustin Landscape and
Lighting District. The initial area that was included within this district was a
parcel of land which was generally bounded by the Santa Aha Freeway on the south,
Myford Road on the east, Irvine Blvd. on.the north and Browning Ave. on the west.
This initial area included the Tustin Auto Center development and Phase I of the
East Tustin development.
Each year after the formation of a district in June-July, the annual assessment
levy is prepared in the form of the Engineer's Repont and presented to the City
Council for their review and action via the process of a public hearing.
Additionally, once each year at the time of the annual assessment levy, additional
parcels may be annexed to the district.
DISCUSSION:
The attached Resolution provides the necessary vehicle to initiate the proceedings
for the annual levy of assessments on the existing Tustin Landscape and Lighting
District and provides for the annexation of additional parcels to the district.
The City's Consultant Engineer will evaluate the past year's assessments on the
existing district with respect to revenues (assessments) and the past years
operating costs. Depending on whether there was a shortfall or surplus of
revenues, he will recommend either an increse or decrease in the 1986-87 assessment
to balance the operation. Additionally, for the 24 new parcels to be annexed he
will estimate the cost of operations/maintenance for 1986-87 and recommend an
assessment for each new parcel based upon benefits received.

Each of the new parcels to be annexed to the Tustin Landscape and Lighting District
were previously conditioned by the City as they developed. Each of the developers
of these parcels agreed to this condition of annexation to, a Lighting District.
The attached Resolution orders the City's Consultant Engineer to prepare and file a
report in accordance with the Article 4, Chapter 1, Part 2 of Division 15 of the
California Streets and Highways Code and initiates the proceedings for the annual
assessment levy.
Following is a tentative schedule of events for these proceedings:
June 2, 1986
Adopt Resolution to initiate proceedings for the annual
assessment levy and for the annexation of additional parcels
to existing district.
June 16, 1986
Adopt Resolution approving the Engineer's Report for the
annual levy of assessments and for annexation of additional
parcels to the district.
Adopt Resolution declaring the City Council's intention to
order the annexation of additional parcels to the ex~sting
district and to provide for an annual levy of assessment,
and to give notice of the time and date for a public hearing
on same.
July 7, 1986
Hold public hearing and adopt Resolution confirming the
1986-87 assessments and the annexation of additional parcels
to the existing district.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, INITIATING PROCEEDINGS FOR THE ANNUAL ASSESSMENT
LEVY AFTER FORMATION OF A DISTRICT PURSUANT TO THE PROVISIONS
OF THE LANDSCAPING AND LIGHTING ACT OF 1972 AND FOR THE
ANNEXATION OF ADDITIONAL TERRITORY TO SAID EXISTING DISTRICT
WHEREAS, the City Council of the City of Tustin, California, desires to
initiate proceedings pursuant to the provisions of the "Landscaping and
Lighting Act of 1972" being Part 2 of Division 15 of the Streets and Highways
Code of the State of California, for the annual levy of assessments for the
payment of the expenses of providing and servicing public lighting within the
Tustin Landscape and Lighting District and to annex certain additional
territory to the existing district; and.
WHEREAS, the City Council of the City of Tustin 'has entered into an
agreement with B.S.I. Consultants, Inc. (hereiDafter referred to as
"Engineer") to perform the engineering services required in said proceedings.
NOW THEREFORE, the City Council of the City of Tustin does hereby resolve
as follows:
SECTION 1. The City Council of the City of Tustin hereby initiates
proceedings for the annual levy of assessments in the City of Tustin for the
installation, maintenance, servicing and operation of those public lighting
facilities within the Tustin Landscaping and Lighting District (described in
Section 2. hereof) and to annex additional territory to the existing district
and more specifically described in Exhibit "A" attached hereto and by this
reference incorporated herein as set forth in full and to levy and collect
assessments to pay the cost thereof, all pursuant to the provisions of Part 2
of Division 15 of the Streets and Highways Code of the State of California.
Said installation, maintenance, servicing and operation is to include but not
be limited to the costs of improvements, necessary repairs, replacement, fuel,
power, electrical current, materials, equipment, labor and supervision in
connection with said public lighting facilities and making improvements
thereto as defined by the Streets and Highways Code Section 22525.
SECTION 2. The Assessment District generally encompasses all of the
territory bounded by the Santa Ana Freeway on the south, Myford Road on the
east, Irvine Boulevard on the north and generally Browning Avenue on the
west. Additional areas to be annexed are outlined on Exhibit "A".
SECTION 3. The Engineer is hereby ordered to prepare and file a report
in accordance with Article 4 (commencing with Section 22565) of Chapter I of
Part 2 of Division 15 of the Streets and Highways Code of the State of
California.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council held
on June 2, 1986.
