D85-153 06-02-86AGENDA DATE: MAY 28, 198~ NEW BUSINESS NO. 2 6-2-86 Inter- Com TO: FROM: SUBJECT: WILLIN~ HUSTON, CITY MANAGER PUBLIC WORKS DEPARTHENT/ENGINEER[NG DIVISION AGREEMENT NO D85-153 EL MODENA-IRVINE FLOOD CONTROL CHANNEL (FACILITY FO7) RECOMMENDATION: For City Council meeting of June 2, 1986. That the City Council approve Agreement No. 085-153 for improvements to the E1 Modena-Irvine Channel and authorize the Mayor to execute said agreement on behalf of the City. BACKGROUND: The E1 Modena-Irvine Channel is a regional flood control facility located adjacent to Bryan Avenue between Browning Avenue and a point 4,000 + feet easterly of Browning Avenue, and between Bryan Avenue and.the Santa Ana Freeway. As a part of the East Tustin developments, and with funding provided by the. East Tustin Assessment District No. 85-1, the City is proposing to construct this facility to its ultimate size as well as to realign the facility both northerly and westerly. The ultimate improvements of this facility are required as a part of the East Tustin development to provide protection to the community from the lO0-year flood. DISCUSSION: Agreement No. D85-153 is a two party agreement between the Orange County Flood Control District and the City and provides for the City to be lead agency for the design and construction of the E1 Modena-Irvine Channel improvements. Upon completion of the construction portion of this project, the facility and right of way will be turned over to the Orange County Flood Control District for on-going maintenance and operation of the system. Both the County and City staff's have prepared this agreement which has been reviewed and approved by the City Attorney's office. The final agreement will be completed on Thursday, May 29, 1986, and will be forwarded to the City Council under separate cover prior to the June 2, 1986 City Council meeting. After City Council execution of the said agreement, it will be forwarded to the County for the Board's approval and execution. MAY 28, 1986 PAGE TWO Also on the June 2, 1986 Council agenda, is an action item authorizing the advertisement of bids for the E1 Modena-Irvine Channel improvements. It is extremely important that this project be kept on schedule so that all channel improvements within the waterway can be completed on or prior to November 1st and the upcoming rainy season.
