HomeMy WebLinkAboutPH 1 VACATION MYFORD 06-16-86.AGENDA DATE: ,,1UNE 4, 1986 PUBLIC HEARING NO. 1 6-16-86 Inter- Com TO: FROM: SUBJECT: HONORABLE HAYOR AND HEHBERS OF THE CITY COUNCIL PUBLIC WORKS DEPARmENT/ENGINEERING DIVISION VACATION AND ABANDONNENT OF A PORTION OF HYFORD ROAD AT DOM AVENUE (FILE ~2433) RECOMMENDATION: It is recommended that pending results of the public hearing, and if the City Council desires to vacate and abandon a portion of Myford Road within the limits stated, that the attached Resolution be passed and adopted by the City Council at their meeting of June 16, 1986. BACKGROUND: At their meeting of May 19, 1986, the City Council adopted Resolution No. 86-61 declaring its intention to vacate and abandon a portion of Myford Road and fixing a time and place for the public hearing thereof of June 16, 1986 at 7:00 p.m. The public hearing has been duly posted and noticed for todays City Council meeting at 7:00 p.m. After the public hearing has been completed, and if the Council so desires to vacate and abandon that portion of Myford Road, the attached Resolution will require adoption. This Resolution provides for permanent easements per Section 8330 of the Streets and Highways Code for all existing public utilities within that portion of Myford Road to be vacated and abandoned. Once the adopted Resolution is recorded at the County Recorder's office, the proceedings on this abandonment action are complete. Said Resolution has been duly published according to law, and Said notices of said hearing have been posted as required by law, and A public hearing has been duly called, noticed and held according to law, and all persons interested in or objecting to the proposed vacation and abandonment appearing at 'said hearing were heard. Said portion of streets are.not necessary for present or prospective public street purposes, except for public utilities. That the Planning Agency by adoption of Resolution No. 2332, dated May 12, 1986, has determined that the subject property should be declared excess to the City's needs and disposed of for private development. g. Categorical exemption from EIR requirements. 2. The City Council hereby orders the vacation and abandoment of that portion of Myford Road designated on Exhibit "A" and "B" attached hereto, subject to the reservation of easements per Section 8330 of the Street and Highway Code. 3. The City Clerk is directed to cause a certified copy of this Resolution, duly attested by the City Clerk under the seal of the City, to be recorded in the office of the County Recorder of the County of Orange. the PASSED AND ADOPTED at a regular meeting of the City Council held on day of , 1986.
