HomeMy WebLinkAboutCC 5 VARIANCE 86-3 06-16-86CONSENT CALENDAR NO. 5' 6-16-86 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 86-77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, UPHOLDING AND MODIFYING PLANNING COMMISSION APPROVAL OF VARIANCE NO. 86-3 FOR THE SHOPPING CENTER KNOWN AS TUSTIN PLAZA. The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: That a proper application (Variance No. 86-3) was filed by Carver Development requesting to vary from requirements of the City of Tustin SignCode by authorizing the following: 1. Six (6) center identification signs; 2. Two (2) free-standing tenant identification signs; and 3. Four {4) tenant identification, wall type signs, square feet each. 150 That a public hearing before the Planning Commission was duly called, noticed and held on said application. That through the course o~ public testimony and Commission discussion, consideration of the application submitted was limited to center identification signs, as requested; free-standing tenant signs, as requested; and tenant wall signs not to exceed 15%'of storefront areas. That the Planning Commission, by the adoption of Resolution No. 2323 authorized the following signage: Six (6) Center Identification Signs. Lettering on center identification design features at complex entrance points shall be individual, back-lit, letters not to exceed 12 inches in height. Wall signs for tenants occupying suites numbered 23, 24, 25 and 26 as shown on the attached site plan (Exhibit "A") shall be limited to 15% of each suite's storefront area. In no case shall sign area for any sign exceed 150 square feet. Two (2) free-standing tenant identification signs, final locations to be determined by the Director of Community Development. Each sign structure shall be a maximum of 35 square feet and 6 feet above grade. That upon appeal of the City Council, approval of Variance 86-3 was scheduled for public hearing before Council. F. That said appeal hearing was duly noticed and held on June 1986. Ge That the City Council ratified signage listed in items I.D.1 and I.D.2 of this resolution authorizing center and tenant {Wall sign) identification. Ho That the City Council overruled Commission approval of signs indicated in item I.D.3 of this resolution, thereby denying the use of free-standing tenant identification signs based upon the following findings: 1. That no special circumstances exist on the site that warrant free-standing tenant identification signs for selected tenants. II. The City Council hereby ratifies, in part, Planning Commission approval of Variance 86-3 as follows: A. Approval of six (0) center identification signs as authorized on Planning Commission Resolution No. 2323 is hereby ratified. Approval of tenant identification wall signs in excess of maximum sign area allowed as authorized in Planning Commission Resolution No. 2323 is hereby ratified. Ce Approval of free-standing tenant identification signs as authorized in Planning Commission Resolution No. 2323 is hereby overruled denying the use of such signage.
