TRANSFER OF TERRITORY FROft CITY OF SANTA ANA TO CITY OF TUSTIN
REC01~IENDED ACTION:
Approve the initiation of the reorganization by the adoption of Resolution No.
86-67.
BACKGROUND:
Larry Gable, Vice President of Mutual Propane has requested that the City of
Tustin re-initiate a transfer of territory from the City of Santa Ana to the
City of Tustin. Mutual Propane owns two adjacent parcels of land which front on
Edinger Avenue just east of the Costa Mesa Freeway. The larger parcel is within
the City of Tustin which provides police and fire services. The smaller parcel
(A. P. #430-252-01) is in the City of Santa Ana. (Please see attached map for
Orange County Municipal Reorganization No. 91.)
In 1977 this annexation was initiated by.the City of Tustin and for unknown
reasons was never completed. In 1977 the City of Santa Aha had approved a
resolution which agreed to the transfer of territory, however, staff has
requested that Santa Ana adopt another resolution.
STAFF ANALYSIS:
Staff feels that the request is logical and should be re-initiated for the
following reasons:
While the City of Tustln presently serves both parcels, Santa Ana city
utility services are not available to serve the property.
The property lies east of the Newport Freeway which is a physical geographic
boundary between the two cities.
3. The freeway boundary facilitates jurisdictional determinations with regard
to fire and police service requests.

The property is within the approved Sphere of Influence of the City of
Tustin. ,
The property owner logically desires to eliminate the confusion of his
property holding being divided between two jurisdictions.
The tax loss to Santa Ana is reasonably small, approximately $100.00 per
year.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN PETITIONING THE LOCAL AGENCY FORMATION
COMMISSION TO TAKE PROCEEDINGS FOR A TRANSFER OF
TERRITORY FROM THE CITY OF SANTA ANA TO THE CITY
OF TUSTIN KNOWN AS ORANGE COUNTY MUNICIPAL
REORGANIZATION NO. 91.
The City Council of the City of Tustin does hereby resolve as follows:
I'. The City Council of the City of Tustin finds and determines:

That Mutual Liquid Gas and Equipment Company, A California
Corporation, hereinafter referred to as "Company", is the owner
of record of that certain real property fronting on the north
side of Edinger Avenue immediately east of the Newport Freeway
and identified as Assessor's Parcel Number 430-252-01, which
real property lies within the corporate limits of the City of
Santa Ana.

That said real property consists of approximately 0.40 acre and
is part of 48,243 square feet used by Company in the operation
of its business at that location, the remainder of which lies
within the City of Tustin and is identified as Assessor's Parcel
Number 430-252-02.

That subject property which lies within the City of Santa Ana is
separated from other portions of the City of Santa Ana by the
Newport Freeway, and lies within the Sphere of Influence of the
City of Tustin, as determined by the Local Agency Formation
Commission of the County of Orange.
That said detachment from the City of Santa Ana and annexation
to the City of Tusttn meets the approval of the property owner,
with a letter of consent attached hereto as Exhibit "C".
That said annexation proposal and boundary line adjustment is in
conformance with the City of Tustin General Plan.
That the City o~ Tustin is the lead agency as defined by the
guidelines for implementation of the California Environmental
Quality Act, this proposal is catagorically exempt from the
requirement for an Environmental Impact Report.

II.
The City Council of the City of Tustln hereby petitions the Local
Agency Formation Commission, to approve the annexation to the City of
Tustin of the property as described and depicted in Exhibits "A" and
"B", with a waiver of hearing and not~ce.
PASSED AND ADOPTED at a regular meeting of the City Council, held on the
day of , 1986.

EXHIBIT A
Beginning at the most northerly ~orner of Block 10, Irvine's Subdivision as per
map recorded in Book 1, Page 88 of miscellaneous maps, records of Orange County,
California;
Thence, N. 50° 11 '05~., along the northwesterly prolongation of the
northeasterly line of said Block 10, a distance of 30.00 feet to a point on the
previous City of Tustin boundary as established by the South Tustin Avenue Annexation
No. 2, passed and adopted per ordinance No. 146, dated February 6, 1961;
Thence, S.39°48'55'"W., along said previous City of Tustin boundary, a distance
of 242.92 feet to an angle point in the existing City of Tustin boundary, said angle
point being the-~rue Point of Beginning.
Thence, continuing S.39°48'55~W., along the existing City of Tustin boundary as
established by the Newport-Edinger Annexation No. 65 per Resolution NO. 70-30, passed
and adopted June 15, 1970, said City of Tustin boundary also being the existing City
of Santa Ana boundary as establised by th~ Newport end Ritdqey annexation per
ordinance No. NS844, a distance of 96.96 feet to the point of intersection with the
southeasterly prolongation of the southwesterly line of that certain parcel of land
described in a corporation grant deed recorded May 27, 1976 in Book 1175, Pages 199
and .200 of Deeds, Pmcords of said Orange County;
Thence, leaving said City of Tustin boundary end said City of Santa Ana
Boundary, N.52'54'48'"W., along said southeasterly prolongation, a distance of 20.01
feet to a point on the southwesterly line of said parcel of lam~,said point also
being a point on the northerly right-of way line of Edinger Street and also being the
beginning of a tangent curve concave southwesterly and having a radius of 1050 feet;
Thence, along said southwesterly line end said northerly right-of-way line of
Edinger Street, along the arc of said curve through a central angle of 6°26'19" an
arc distance of 117.99 feet to the most westerly corner of said parcel of land;
Thence, leaving said northerly right-of-way line of Edinger Street,
N. 19'43'03"E., along the westerly line of said parcel of land, a distance of 93.76
feet to an angle point in the existing City of Tustin boundary, as established by the
previously m~ntioned South Tustin Ave. Annexation No. 2, said angle point also being
an angle point in the existing City of Santa Ana boundary;
Thence, leaving said westerly line, along the existing City of Tustin boundary
per above mentioned South Tustin Avenue Annexation No. 2 and the existing City of
Santa Ana boundary through the following courses:
8.50°11'05"E., a distance of 43.06 feet; thence, N.89°51'49"E., a distance of
111.63 feet; thence, S00°19'45'"W., a distance of 64.27 feet to the True Point of

Dear Mr. Davis:
Pursuant to our telephOne conversation, I would like to
request the City of Tustin to annex a small parcel currently
in the City of Santa Ana.
Mr. Mel Moore worked with Mary Ann about eight years ago
regarding this annexation. The papers were filed at this
time at the request of the City of Tustin.
Enclosed is a parcel map which depicts the property in
question. Please let me know what needs to be done to com-
plete this.
