TUSTIN LANDSCAPE AND LIGHTING DISTRICT (FILE A270g)
RECOMMENDATION:
For City Council meeting of June 16, 1986.
Pass and adopt Resolution No. 86-75 approving the Engineer's Report for the annual
levy of assessments and for annexation of additional territory to said existing
district, and Resolution No. 86-76 setting the time and place of a public hearing
on said annual levy of assessments and annexation of additional territory to said
district.
BACKGROUND:
On June 2, 1986, the Tustin City Council passed and adopted Resolution No. 86-74
which initiated proceedings for the annual assessment levy after formation of a
district pursuant to the provisions of the Landscape and Lighting Act of 1972 and
for the annexation of additional territory to said existing district.
The City's consultant has prepared the Engineer's Report which outlines the
boundaries of the assessment district, proposed assessments upon assessable lots
and parcels of land within the district and a full description of the street
lighting energy costs. A copy of this report is attached for Council review and
information.
As previously indicated in my May 28, 1986 staff report, each of the new parcels
to be annexed to the Tustin Landscape and Lighting District where previously
conditioned by the City to complete annexation to this district as a condition of
their development. Each of the developers of these parcels agreed to this
condition of annexation to a lighting district.
DISCUSSION:
Attached, are two Resolutions No. 86-75 and No. 86-76. Resolution No. 86-75
approves the Engineer's Report for the annual levy of assessments and for the
annexation of additional territory to said existing district. The second
Resolution No. 86-76 declares the City Council's intention to annex additional
territory to an existing district and to provide for an annual levy of assessment
for said district. Resolution No. 86-76 also sets the date and time of the public
hearing for public input on these matters as Monday, July 7, 1986, at 7:00 p.m. in
the City Council Chambers, 300 Centennial Way, Tustin, California. This public
hearing will provide the opportunity for all interested persons to be heard
concerning the annexation of additional territory to the existing district and the
annual levy of assessments of the district.

RESOLUTION NO. 86-75
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
ORANGE COUNTY, CALIFORNIA, APPROVING THE ENGINEER'S
REPORT FOR THE ANNUAL LEVY OF ASSESSMENTS FOR THE TUSTIN
LANDSCAPE AND LIGHTING DISTRICT AND FOR THE ANNEXATION
OF ADDITIONAL TERRITORY TO SAID EXISTING DISTRICT
WHEREAS, by Resolution'No. 86-74, the City Council initiated proceedings
for the annual levy of assessments~ the annexation of additional territory
to said existing district and ordered the Engineer to prepare a report in
accordance with Section 22565 of the State of California Streets and Highways
Code; and
WHEREAS, pursuant to said Resolution, the Engineer has filed the report
~ith the City Clerk on the 16th day of June, 1986; and
WHEREAS, the City Clerk has submitted the report to the City Council and
the City Council now has reviewed and examined the report as so submitted.
NOW, THEREFORE, the City Council of the 'City of Tustin does hereby
resolve as follows:
SECTION 1. The report prepared by the Engineer including description of
the improvement, estimated costs and diagram, as filed with the City Clerk on
the 16th day of June, 1986, is hereby approved.
SECTION 2. A copy of this report shall remain on file in the office of
the City Clerk.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council held
on the 16th day of June, 1986.

RESOLUTION NO. 86-76
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
ORANGE COUNTY, CALIFORNIA, DECLARING ITS INTENTION TO
ORDER THE ANNEXATION OF ADDITIONAL TERRITORY TO AN EXISTING
DISTRICT AND TO PROVIDE FOR AN ANNUAL LEVY OF ASSESSMENT
FOR THE IMPROVEMENT, MAINTENANCE AND SERVICING OF PUBLIC
LIGHTING FACILITIES WITHIN THE BOUNDARIES OF THE TERRITORY
INCLUDED IN THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT AND
TO LEVY AND COLLECT ASSESSMENTS PURSUANT TO THE LANDSCAPING
AND LIGHTING ACT OF 1972 AND GIVING NOTICE THEREOF.
WHEREAS, the City Council by Resolution No. 86-74 initiated proceedings
for the annual levy of assessments and annexation o-ir-~itional territory to
an existing district for the Tustin Landscape and Lighting District pursuant
to the provisions of the Landscaping and Lighting Act of 1972 (Part 2,
Division 15 of the California Streets and Highways Code); and
WHEREAS, by said Resolution No. 86-74, the City Council ordered the
Engineer to prepare a report pursuant to Section 22565 of said Code; and
WHEREAS, the City Engineer did prepare and file such a report and the
same was approved by the City Council on the 16th day of June, 1986, by
Resolution No. 86-75.
NOW, THEREFORE, the City Council of the City of Tustin does hereby
resolve as follows:
SECTION 1. That the public interest and convenience require and it is
the intention of the City Council of the City of Tustin to order the
annexation of additional territory to an existing district and to order the
annual levy of assessments and to levy and collect said assessments pursuant
to the provision of said Landscaping and Lighting Act of 1972, (Part 2 of
Division 15 of said Streets and Highways Code).
SECTION 2. That the improvements to be undertaken consist of the
installation, maintenance, servicing and operations of those certain public
lighting facilities located within the Tustin Landscape and Lighting
District. The assessment district designated as Tustin Landscape and Lighting
District generally encompasses all of the territory bounded by the Santa Ana
Freeway on the south, Myford Road on the east, Irvine Boulevard on the north
and generally Browning Avenue on the west except the areas of all public
streets, avenues, lanes, alleys, rights of way, parks and all public school
property being used for public purposes, provided, however not with the
foregoing, property owned by railroad and public utility companies not used
for public purposes shall be included in the district and not be excluded
pursuant to the aforesaid exceptions. Additional areas to be annexed are
outlined in Resolution No. 86-74, Exhibit "A".
SECTION 3: That reference hereby is made to the report of the Engineer
on file with the City Clerk and open to inspection, for a full detailed
description of the improvement, the boundaries of the Assessment Distirct and
any zones therein, and the proposed assessments upon assessable lots and
parcels of land within the District.

SECTION 4: That said proposed installation, maintenance, servicing and
operation in the opin'ion of.the City Council of the City of Tustin will be to
the benefit of the property lying within the described boundaries of the
Assessment District, as said Assessment District is described and defined in
said Engineer's Report.
SECTION 5: Notice is hereby given that Monday, July 7, 1986, at the hour
of 7:00 p.m. in the City Council Chambers, 300 Centennial Way, Tustin,
California, 92680 are hereby fixed as the time and place where all interested
persons may appear before the City Council and be heard concerning the
annexation of additional territory to the existing district and the annual
levy of assessments of the District, the extent of the District, the services
to be performed and the proposed assessment and all other matters relating
thereto.
Protests must be in writing and must be filed with the City Clerk prior
to the conclusion of the hearing. Any such protest shall state all grounds of
the objection and if filed by the property owner, shall contain a description
sufficient to identify the property.
SECTION 6: The City Clerk shall cause notice of the hearing to be given
by causing th~ Resolution of Intention to be posted and published in the
manner required by Part 2 of Division 15 of the Streets and Highways Code.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council held
on the 7th day of July, 1986.

GREATER EAST TUSTIN AREA ASSESSI~ENT DISTRICT
RECOMMENDATION:
For the City Council meeting of June 16, 1986.
'That the Tustin City Council:
1.) Accept the petition filed by The Irvine Company requesting formation
of the Greater East Tustin Area Assessment District.
2.) Direct staff to initiate the assessment district proceedings.
BACKGROUND:
On January 12, 1986, The Irvine Company filed a petition requesting the formation
of a second assessment district for East Tustin by the City in order to finance
the design and construction of certain other public improvements not included
within the original Assessment District No. 85-1.
DISCUSSION:
The intent of this district is to finance that portion of the Tustin Ranch Road
(Jamboree Road)/I-5 interchange not included within the original Assessment
District No. 85-1 (28%), traffic signals along Irvine Blvd. (approximately 50%}
and'the horth-south arterial between Irvine Blvd. and the northerly City limits.
The general boundaries of this district is all of the East Tustin land northerly
of Irvine Blvd. Exhibit A of the petition will be available at the City Council
meeting of June 16, 1986.
The process of this assessment district would be similar to that of the existing
district and will only affect the current and future property owners within the
proposed area of assessment. It will not financially impact any City residents
outside the assessment area. This proposed district would also be formed under
the provisions of the Municipal Improvement Act of 1913 and financed through bonds
under the provisions of the Improvement Bond Act of 1915,

Dear Mayor and Members of the Council:
A petition requesting formation of a second assessment district for East Tustin
by the City of Tustin to finance the design, engineering and construction of
the Jamboree Boulevard/I-5 interchange, traffic signals on Irvine Boulevard,
and a north-south arterial, is enclosed. All of the property to be included
in this second assessment district is owned by The Irvine Company.
The formation of this assessment district will accomplish two desired goals.
It will provide for funding of the Jamboree Boulevard/I-5 interchange in
concert with Assessment District 85-1, and will provide funding for the design,
engineering and construction of the north-south arterial and traffic signals
on Irvine Boulevard. As with Assessment District 85-1, the formation of this
assessment district is intended to supplement and not preclude other public
funding sources that may be available for these regional improvements.
We appreciate your consideration of the enclosed petition, and will be
available to meet with you and City staff at your convenience to review in
further detail the scope of proposed improvements and their funding and to
respond to any quesitons you may have.

PETITION
To the Honorable Mayor and Council of the City of Tustin:
The undersigned petitioners and property owners,
owning property within the boundaries of a proposed
assessment district, as said area is shown on a map attached
hereto, request the City Council to initiate proceedings for
the formation of a special assessment district, pursuant to
the provisions of the "Municipal Improvement Act of 1913,"
being Division 12 of the Streets and Highways Code of the
State of CalifoL,ia, to be financed through bonds under the
terms and provisions of the "Improvement Bond Act of 1915,"
being Division 10 of said code.
The petitioners hereby request as follows=
A. The proceedings and improvements shall
include the design, engineering, construction and/or
acquisition of certain street, traffic signal, bridge and
interchange improvements, together with appurtenances and
appurtenant work, as said improvements are generally
described in the attached and referenced Exhibit A and shown
on the map attached hereto.
B. The property owners hereby expressly ~atve
the proceedings required and all limitations under the
"Special Assessment Investigation, Limitation and Majority
Protest Act of 1931," being Division 4 of the Streets and
Highways Code of the State of California and as authorized
by Section 2804 of said Streets and Highways Code.
C. This assessment district shall hereinafter be
known and referenced as the Greater East Tustin Area.
D. The property owners further acknowledg~ that
all costs and expenses including incidental expenses ~n the
assessment district will be assessed in accordance with the
benefits received from the work of improvement.
E. The property owners further request that all
efforts and attempts be made so that the proceedings and the
Resolution of Intention can be adopted at the earliest date.
This petition was filed with the City Clerk of
the city of Tustin on this day of , 1986.
