PROPERTY OtiNER DISCUSSION: At the last City Council meeting, a citizen on "8" Street requested Council to investigate building construction occurring at 545 "8" Street relative to its compliance with buildtng and zoning codes. Additionally, the neighbor filed specific complaints concerning damage to his property resulting from the neighboring construction and the overall nuisance it is causing. Following the Council hearing, the next morning staff building inspectors visited the · subject property owned by Walt Fredrtksen which is the site of a five unit apartment house presently under construction. The project, you may recall, was approved for four units by the Planning Commission and subsequently increased to a five unit project by City Council. Building construction consists of two story wood frame and modular dwelling units located adjacent to the southerly property line with the driveway access along the northerly property line. The neighbor, Mr. Anderson, has been subjected to the nuisance of excavation dirt spilling onto his yard and damage to the common wood fence between the subject properties. Staff inspectors communicated with Mr. Anderson to verify the fact that the debris and excess dirt will be removed from his yard and ultimately a retaining wall topped with a six foot wooden fence will be built between his property and Mr. Fredriksen's. Furthermore, Mr. Anderson's privacy will be somewhat reinstated with the six foot fence partially obscuring direct view between his household windows and the neighboring first floor windows. However, the second floor apartment windows were not restricted by the Planning Commission or Council and therefore will have full view of Mr. Anderson's yard, which is permissible by the R-1 zone district. Overall, while staff agrees that Mr. Anderson has been subjected to some nuisance, the nature of building construction unfortunately is disruptive to a residential area but, only temporarily. Upon the apartment project's completion, staff will again review Mr. Anderson's concerns and ensure that both properties are in compliance and protected pursuant to R-1 zone regulations.
