APPEAL OF PUUJNING CO~t~ISSION APPROVAL OF USE PERJRIT 84-27
BACKGROUND:
On December ~0, 1984, the Planning Commission approved Use Permit
84-27
authorizing the development of a self-storage facility at 550 W. Sixth Street.
The Commission determined that the project is an appropriate land use for the
Planned Industrial (PM) Zoning designation. Further, the Commission was
satisfied that sufficient conditions of approval were imposed to ensure
architectural compatibility with the surrounding area.
In an action taken on December 18, lg84, the Council appealed the Planning
Commission approval of Use Permit 84-27. The appeal was prompted by concern
over water easement that encumbers the property.
DISCUSSION:
As approved, the project encroaches into the water easement on the property.
However, staff does not consider this encroachment to be detrimental to the
function for which the easement was originallyrequired.
The applicant has submitted a proposal that would cause the use of a ten (10)
foot portion of the easement to be reverted to the subject property. However,
the mechanism by which this is to be accomplished is still being reviewed by
this Department, along with the City Engineer, and City Attorney. A thorough
analysis of the project and the easement proposal will be complete by the next
Council meeting.
RECOI~ENDED ACTION:
It is recommended that the public hearing be continued to the February 4, lg85
Council meeting when full analysis of the water easement issue will be
presented.
