OLD BUSINESS NO. 1 1-21-85 Inter- Com TO: FROM: SUBJECT: WILLIAM HUSTON, CITY MANAGER BOB LEDENDECKER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER PARKING RESTRICTIONS AT CENTENNIAL PARK RECOMMENDATION: That the Tustin City Council, at their meeting of January 21, 1985, authorize the installation of signing to restrict on-street parking to four hours between 6:00 a.m. and 6:00 p.m. on both Devonshire Avenue and Roanoke Avenue adjacent to Centennial Park. BACKGROUND: On December 17, 1984, the City Council considered a request from the Tustin Meadows Homeowners Association for a four hour parking restriction between 6:00 a.m. and 6:00 p.m. on Devonshire Avenue and Roanoke Avenue adjacent to Centennial Park. At this meeting the City Council questioned whether existing City Codes covered the prohibition parking on public streets when displaying a vehicle for sale and requested staff to investigate same. DISCUSSION: The City Attorney has reviewed Section 5330(f) and discussed this matter with Police Chief Thayer and it is their opinion that it may be difficult to convince Municipal Court judges that Section 5330(f) of the Tustin City Code is enforceable. A copy of my previous memo idated 12-6-84 and a copy of the City Attorney"s memo dated 1-9-85 are attached for information. It is the recommendation of the City Attorney's office and concurred by the Tustin Meadows Homeowners Association that the four hour limitation be imposed. Inter-Corn of December 19, 1984, and discussion with Chief Thayer, it is our opinion that it may be difficult to convince Municipal Court judges that Section 5330(f) of the Tustin City Code is enforceable. Accordingly, and after discussion with Kathy Well of the Tustin Meadows Homeowner's Association, it is our recommendation (with which she has concurred) that the City impose a four hour parking restriction on those portions of these streets and that we see how well that solves the problem. If the four hour parking limitation does not solve the problem (and it may well not) we would recommend that we then go to a two hour parking limitation, even though a two hour parking limitation will pose some problems for legitimate users of Centennial Park. BACKGROUND: The Tustin Meadows Com~ntty Associated has requested that two locations as follows: o On Devonshire Avenue adjacent to Centennial Park ° On Roanoke Avenue adjacent to Centennial Park be posted for "Four Hour Parking Any Time". As indicated on the attached letter of request, this restriction will h~pefully discourage these areas for parking vehicles which display advertising add for sale signs. DISCUSSION: Section 53~f the Tustin City Codes states the following: No operator of any ve~icle shall park said vehicle upon any street in this city advertising or displaying it for sale, unless authorized by Resolution of the City Council. This section only pertains to vehicles for sale and does not cover other types of advertising displayed on vehicles such as garage sales, etc. Section 5331e of the Tusttn City Code provides for the implementation of a four hour parking zone as requested. We have a terrible problem with cars Parking there with "For Sale" signs on them. Could these two areas be signed for "4 hour Parking"?
