ENGINEERING ON BEHALF OF KING COOPER LOCATION: 2911 and 2961 BOtt AVENUE REQUEST: SUBDIVIDE ONE PARCEL INTO lliO PARCELS BACKGROUND: On January 14, 1985, the Planning Commission adopted Resolution No. 2022 which recommended approval of this tentative map. The subject map of 4.933 acres proposes to subdivide one parcel into two parcels. Both parcels after subdivision would comply wi th the zoning regulations and are in conformance with the Tustin Area General Plan. Condition II B of the Planning Commission Resolution states, "separate sanitary services, domestic water service and any required fire service shall be provided to each parcel." These conditions are current City Policy as adopted in Resolution 81-4. Because both parcels are fully developed and share one common sewer lateral, the applicant has requested (in the attached correspondence) that they be allowed to keep the common sewer lateral. The applicant has also submitted CC&Rs which establishes a plan for reservation and maintenance for these easements. These CC&Rs have been reviewed by the City Attorney and are acceptable with a few minor revisions. RECOIIIENDATION: Approve Tentative Parcel Map 84-1033 by the adoption of Resolution No. 85-1. I.S. 422B Mak~ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO.' 85-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY TUSTIN, APPROVING TENTATIVE PARCEL MAP 84-1033 LOCATED AT 2911 AND 2961 DOW AVENUE The City Council of the City of Tustln does hereby resolve as follows: II. The City Council finds and determines as follows: A. That Tentative Parcel Map No. 84-1033 was submitted pursuant to Ordinance No. 847 by R.B. Engineering on behalf of King Cooper for the purpose of creating two lots from one lot known as 2911 and 2961 Dow Avenue. B. That said map is in conformance with the Tustin Area General Plan. C. This project is categorically exempt from the requirements of the California Environmental Quality Act. The City Council hereby approves Tentative Parcel Map No. 84-1033 subject to the following conditions: A. Construction and/o~ replacement of all missing or damaged publ4c improvements will be required and shall include, but not be limited to, the following: Ce 1. Driveways 2. Domestic water services 3. Fire services 4. Sidewalks 5. Sanitary sewer laterals Separate domestic water service and any required fire service shall be provided to each parcel. Reciprocal access agreement which should be shown on the map. The proposed property line at the northerly end of the parcels shall be made into a planter area rather than a parking space. If the owner retains the common sewer service then the owner shall record a covenant which grants a perpetual easement from parcel 2 to parcel 1 for the common sewer lateral. WYNN, City Clerk January 10, 1985 City of Tustin 'City Council 300 Centennial Way Tustin, California 92680 Re: Tentative Parcel Map 84-1035 located at 2911 and 2961 Dow Avenue- Resolution no. 2202 Councilmembers, This letter is a request to amend condition' II-B to require separate domestic water services and ~ny required fire services to each parcel but allow the one existing common sanitary sewer service to remain, The upkeep and continued maintenance of this common sanitary service would be guaranteed by a covenant ~recorded concurrently with the final Parcel Map and would run in perpetuity with the land. I have enclosed for your review,a sketch indicating the original construction location of the sewer lateral and a rough draft of the above mentioned covenant prepared by my client's attorney. It should also be noted that this covenant also provides for upkeep and continued, maintainence of all utilities as well as parking and drive surfaces and recriprocal rights for ingress-egress and parking.
