HomeMy WebLinkAboutRPT 4 CALIFORNIA APTS 02-04-85REPORTS NO. 4 Status Report DATE: TO: FROg: SUB,1ECT: danuary 28, 1985 HONORABLE RAYOR AND CITY COUNCIL CDIII~IIITY DEVELOPlqEKr DEPARTilEKI* STATUS R~PORT CONCERNING CALIFORNIAN APARTHENTS 14882 NEWPORT AVENUE DISCUSSION: Last fall, tenants from the Californian Apartment project approached City Council requesting assistance. On December 18, 1984, the City Council confirmed it was improper for the property owner to charge for parking spaces that are required by City code. Following the Council hearing on December 27th, notice was mailed to the property owner, L'ABRI Properties, reflecting Council's opinion. On January 7, 1985, Mayor Kennedy and City staff met with representatives from L'ABRI Properties to discuss issues raised by tenants. Resulting from that meeting L'ABRI Properties agreed to the following: 1. Provide a list of improvements made to date and a schedule for future improvement of the apartment complex. 2. Work with staff to resolve how parking spaces could be assigned per unit in relation to unit size and. location. 3. L'ABRI would relocate tenants from units with severe problems to newly refurbished units when available rather than effect repairs in an occupied unit occupied by a tenant. Following the January 7th meeting, staff received a letter dated January 11, 1985 from L'ABRI Properties outlining their property improvement schedule from August 1984 to June 1, 1985. At the Council meeting on January 21, 1985, again tenants of the Californian voiced concern that L'ABRI Properties was still charging for parking spaces and had not complied with Council's request. Additionally, new issues were raised including individual utility meters and the reliability of said meters managed by MC Electric. The tenants further complained that their notices posted on the apartment grounds were being removed by management. On January 25, 1985, L'ABRI management responded with its position permitting notices to be posted in the main laundry room and mailbox area if notices were not derogatory concerning the property or management team. Community Development Department City Council Californian Status page ~o As of this staff report date, L'ABRI Properties is attempting to comply with City requests including resolving assignment of open parking and new garages and how to equitably charge those tenants receiving garages rather than carports. Concerning the balance o[ the issues, the majority are civil in nature concerning landlord/tenant disputes over quality of property maintenance. Staff will continue to investigate tenant complaints where possible. However, Council should realize this is the only apartment project in Tustin generating on-going complaints regardless of property ownership. RECOI~ENDATIO#: Receive and file. DONAL1) D. We will allow these to be POsted in the main laundry room and the mailbox area. Such notices must be typewritten, neat and brief. They must not have any illustrations and must not say anything derogatory about the property or the management team. They certainly may be announcements of meetings, etc. I hope this will satisfy your request. Lamm Director of Community Development 300 Centennial Way Tustin, CA 92680 Re: Parking Policy, Californian Apartments Dear Mr. Lamm: It has been a pleasure working with you, the mayor, and the Council over recent months to make the Californian one of Tustin's finest addresses. In many ways it has been a challenging battle, but your cooperation is definitely helping us win the victory. Pursuant to the Council's recommendation and our discussion of Wednesday, January 30th, we would like to submit the following plan to govern parking at the Californian Apartments: 1. Each unit will be assigned a carport, or an open space if there are not enough carports available. However, we expect enough residents will give up their assigned carport for a credit on their garage charge. 2. 79 carports will be converted into garages with electronic opening devices. This amenity will be compensated for by an additional charge for those using garages. 3. Open spaces, unless we have to assign a few, will remain open on a first come first serve basis. 4. Deposits will be required on the remote control gate operators. Residents may put a deposit on a second remote control unit to use the open spaces and the extra rented garages. We will allow enough gate operators to be issued to insure that all the available parking in the complex is being used. We hope this will provide the best possible situation for everyone involved.
