Huston, City Manager Jeff Kolin, Recreation Superintendent COLUMBUS TUSTIN PARK REVENUE SHARING AGREEMENT EXTENSION RECOMMENDATION: Approve the amendment and authorize the Mayor and City Clerk to execute the agreement extending the revenue sharing funding for Columbus Tustin Park for a period of five (5) years. BACKGROUND: The City of Tustin and the County of Orange entered into an agreement to provide revenue sharing funds for the purchase of Columbus Tustin Park in April of 1974. One parcel of the original land remains under a lease agreement for use by the previous owner (the McCalla Estate). The County of Orange cannot release the revenue sharing funds to the City until the City has title to the land and it is available for public use. The revenue sharing agreement has been extended six times in the past, usually for a period of one or two years. The proposed extension is for five years which will avoid the necessity for additional extensions during that period. Should the McCalla Estate become available for public use during the five-year period of the agreement, the County of Orange would release the funds to the City. Future extensions of the agreement would also be possible if necessary. $34,66? in revenue sharing funds remain to be disbursed. WITNESSETH WHEREAS, CITY AND COUNTY entered into an agreement dated April 30, 1974, as amended July 1, 1975, May 31, 1977, June 30, 1978, September 11, 1979, November 17, 1980, and July 27, 1982, to provide Revenue Sharing funds for the acquisition of three parcels for the Prospect/Irvine Park site; and WHEREAS, one parcel (1.11 acres) of this park site, while purchased by CITY, is still under a lease agreement for use by the previous owner; NOW, THEREFORE, for and in consideration of the mutual promises, covenants, and conditions hereinafter set forth, the parties agree as follows: 1. In all other particulars, said Agreement of April 30, 1974, as amended, shall continue to be in full force and effect.
