FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS - MOULTON PARKWAY/I.C.D./
MYFORD ROAD FAU PROJECT M-M032(O04)
RECOMMENDATION:
It is .recommended that the City Council, at their, meeting of Februar~ 19, 1985,
adopt the attached Resolution accepting subject project and authorize the filing
of the Notice of Completion at the County Recorders office.
It is further' recommended that the City Council authorize payment of the final 5%
retention amount of $313,686.31 30 daYS after the date of recordation of the
Notice of Completion, providing no liens or stop payment notices have been filed
against the project.
BACKGROUND:
Subject project encompassed construction of 2.5 miles of four. and six lane roadway
with two bridges and three major, flood control facilities. Construction began on
July 15, 1983 and was con~leted January 25, 1985 approximately 242 workig days
ahead of schedule. The project is financed with Federal Aid Urban (FAU) funds,
the share ratio being 86.22% FAU funds and 13.78% City funds, which share ratio
pertains to FAU eligible participating construction. The City of Tustin acted as
lead agency on this project from its inception. Inspection services were
contracted out to the City of Irvine who operated under, the supervision of the
Resident Engineer. furnished by the City of Tustln Engineering Division.
DISCUSSION:
This is the largest project, ever administered by the City of Tustin Engineering
Division. The preliminar7 Contract amount based on estimated quantities was
$5,368,529.20. The final contract amount is $6,273,726.29 for' an overrun on the
contract of $905,197.09 or. 16.86%. The contract overrun is due to $648,000.00 in
contract change orders which were written during the course of the project (these
were explained in a previous informational report) and significant plan quantity
errors which were encountered during construction.
The construction cost of this project is being shared between the City of Tustin,
City of Irvine and ~he Irvine Company. The final construction cost share ratio
breakdown is as tabulated below:

*These are construction costs only, and do not include construction engineering
which amounts to about 6% of total construction cost. Construction engineering
costs are being shared between Tustin and Irvine at a ratio of 83.44% Tdstin and
16.56% Irvtne.
Since the start of construction on July 15, 1983, $54,000.00 of budgeted
Engineering Division salaries have been expended on administrati~is
project. Of this amount, $51,830 is eligible for. reimbursement by FAU funding at
the rate of 86.22%. This amounts to $44,700.00 in revenue which has been earned
by the Engineering Division in the course of administering this project or
approximately $2,350.00 per month over the 19 month construction period.
The project has been completed to the satisfaction of the Engineering Division and
the State of California, Department of Transportation. The completion time by the
contractor has saved the agencies a considerable amount in administration costs
and we consider' the contractor's quality of work to be above average.
Attached also, for the Council"s information, is the "inter-agency cost breakdown"
for- the final contract amount.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION
MOULTON PARKNA¥/I.C.D./MYFORD ROAD FAU PROJECT
WHEREAS, SoCal Constructors, having a contract with the City of
Tustin to construct the hereinafter, described public work and improvement; and
WHEREAS, the City Engineer has duly: certified to the construction and
completion of said public improvements hereinafter mentioned in a manner
satisfactory to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed
said public improvement hereinafter more particularly described in accordance
with the provisions of the contract documents and the notice of completion and
acceptance of said public work and improvement should be filed and payment of
the balance due said contract authorized in accordance with the contract
documents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said public work and improvement be, and the same is hereby
accepted. Said public work and improvement is more particularly described as
follows:
MOULTON PARKWAY/IRVINE CENTER DRIVE/MYFORD ROAD FAU PROJECT M-M032(O04)
AND BE IT FURTHER RESOLVED that the City Engineer of the City of
Tustin be, and is hereby authorized to execute and file a notice of completion
and acceptance of said public work and improvement described herein as required
by law.
