HomeMy WebLinkAboutCC 10 USE PERMIT 85-1 03-04-85 1 2 3 4 5 6 7 $ 9 10 11 12 13 14 15 16 17 15 19 20 21 22 23 24 25 26 27 28 CONSENT CALENDAR NO. 10 3-4-85 RESOLUTION NO. 85-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, OVERTURNING THE PLANNING COMMISSION'S DENIAL OF USE PERMIT 85-1 TNEREBY APPROVING A 50 SQUARE FOOT POLE SIGN AT 14460 NEWPORT AVENUE The City Council of the Ci~ of Tustin does hereby resolve as follows: I. The City Council of the City of Tustin does hereby determine as follows: A. That a proper application, (Use Permit No. 8S-I) was filed on behalf of Leonard Cons%ruction, requesting authorization to install a 50 square foot tenant identification pole type sign at 14460 Newport Avenue. B. That a public hearing before the Planning Commission was duly called, noticed and held on said application. C. That the Planning Commission did deny Use Permit 85-1 as submitted, approving a 50 square foot monument sign instead. D. That Michael Lepore, on behalf of Leonard Construction did appeal the action of the Commission to the City Council. E. That.a public hearing before the City Council was duly called, noticed and held on said appeal. That based on new testimony presented by the project applicant and other concerned parties, as well as concern over potential visibility problems associated with a monument sign, the Council finds that a pole type sign is justified and overturns the Planning Commission action on Use Permit 85-1. That the establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced bythe following findings: 1. That a pole type sign as applied for is allowed subject to approval of a Conditional Use Permit. 2. That to avoid potential traffic and/or pedestrian visibility impairment, a monument sign should not be utilized at the subject location. H. That the establishment, maintenance, and operation of the use applied for will not injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. 1 2 3 5 6 7 8 9 10 11 12 13 14 15' 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 85-22 page two I. The project is categorically exempt from the requirements of the California Environmental Quality Act. J. Final development plans shall require the review and approval of the Community Development Department. II. The City Council hereby overturns the Planning Commission denial of Use Permit 85-[ and thereby approves a SO square foot tenant identification pole type sign at 14460 Newport subject to the fo)lowing conditions: The backgrounds of the sign panels shall be white, matching the background of signs currently installed on the structure at subject location; B. The pole cover shall be treated with a rex-coat material tomatch the type and color used on the structure at subject location; C. The existing "Little Kings" pole sign must be removed prior to issuance of sign permits authorizing the proposed sign. The height of the sign shall not exceed the height of the structure being served, and shall 'comply with all other provisions of Tustin Sign Ordinance 684.
