HomeMy WebLinkAboutNB 4 TLLD FORMULAT'N 05-06-85 NEW BUSINESS NO. 4 APRIL 25, 1985 ~~/ ~'--~0~ DATE: TO: THRU: FROM: WILLIAM HUSTON, CITY MANAGER BOB LEDENDECKER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER MONDA BUCKLEY, ADMINISTRATIVE ASSISTANT SUBJECT: RESOLUTION OF INITIATION FOR THE FORMULATION OF A LANDSCAPE AND LIGHTING DISTRICT PURSUANT TO THE LANDSCAPE AND LIGHTING ACT OF 1972 RECOMMENDATION: Request the Tustin City Council, at their regular meeting of May 6, 1985, to adopt the attached Resolution to initiate the formulation of a Landscape and Lighting District pursuant to the Landscape and Lighting Act of 1972. It is further requested that Council direct staff to engage a consulting firm to prepare the engineer's report and all other requirements for the formation of the proposed Assessment District. BACKGROUND: The proposed District area in East Tustin (boundaries are as follows: a) Myford Road to centerline; b) Irvine Boulevard to north street right-of-way; c) Browning Avenue to centerline and, d) Santa Ana Freeway to north right-of-way. See Exhibit A) will eventually require street lighting and landscaping. It is felt that the interests of the community would best be served if the city undertakes the responsibility for these services. Formulation of a Landscape and Lighting District pursuant to the Landscape and Lighting Act of 1972 is a method by which the city can assume the responsibility for operation and maintenance of street lighting and landscaping with costs for same being assessed to each parcel, on the tax role, in accord with the benefit derived by each parcel. Even though an Assessment District is formulated, Council would determine when assessments would commence and if assessments would be levied for street lighting only, landscaping only or both. Formulation of an Assessment District is easier prior to development due to the lesser number of parcels and parcel owners involved. Although easier, the procedure to establish a District is time consuming. Current staffing, in relationship to overall department projects, precludes in-house staff from undertaking this project; also, staff lacks the expertise to complete the assignment in the existing time constraints. Several aspects involved in the formulation of the District require computerization not currently available within the city. There are consultant firms having a great deal of experience in forming a Landscape and Lighting Assessment District. These firms have the necessary computerization readily available and the expertise to expedite the District formulation. Consultant fees, administrative and associated costs can be charged directly to the Assessment District. WHEREAS, it is the intention of the City Council of the City of Tustin, California to provide landscaping and street lighting to all areas of the City of Tustin; and, WHEREAS, it is in the interest of the residents of the City of Tustin that the City of Tustin undertake the responsibility for the operation and maintenance of landscaping and street lighting in the City of Tustin. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that: ® It is proposed to form an Assessment District pursuant to the Landscape and Lighting Act of 1972 {22500 et seq. Street and Highways Code of the State of California). The boundaries of the proposed District are: a) Myford Road to centerline; b) Irvine Boulevard to north street right-of-way; c) Browning Avenue to centerline and, d) Santa Ana Freeway to north right-of-way. It is proposed to install, operate, and maintain street lighting, landscaping, and park areas within the proposed Assessment District. The proposed Assessment District shall be known as the "Tustin Landscape and Lighting District". The Public Works Director/City Engineer is hereby ordered and directed to prepare and file a report in accordance with the provisions of Section 22565 of the Street and Highways Code of the State of California. The foregoing Resolution was approved and adopted at a meeting of the Tustin City Council held on MAYOR ATTEST: CITY CLERK
