FINAL AGREEMENT - EXTENSION OF MYFORO ROAD THROUGH MCAS(H)
RECOMMENDATION
That the City Council approve the final agreement among the cities of Tustin
and Irvine, The Irvine Company and the Marine Corps for the extension of
Myford Road through the helicopter base.
BACKGROUND
The final agreement implements the federal enabling legislation enacted last
year which authorized the Marine Corps to gran% a road easement through the
helicopter base in exchange for avigation easement over the Browning and GCA
corridors. The parties to the final agreement signed a Memorandum of
Understanding {MOU) in March, 1985 wherein the parties agreed to reach the
final agreement by June 30, 1985.
DISCUSSION
The final agreement provides the specific mechanism to accomplish the items
agreed upon by the parties in the MOU. The following are the key points of
the final agreement:
The Irvine Company will grant an avigation easement (acknowl-
edgement of the Marine Corps' right to overfly) over the
Browning Corridor. The Browning Corridor will shift from its
present alignment (Myford Road to Browning Avenue) to E1Modena
Channel {eastern edge of the Auto Center) to Peters Canyon Wash
(east of Myford Road).
The Irvine Company will grant a clearance easement over a
portion of the Browning Corridor within which residential uses
will be prohibited. The clearance easement (which the Marines
will utilize as a visual aid and noise buffer zone) extends 250'
east of the edge of existing Myford Road for a distance of two
miles from the helicopter base. This easement will be relocated
to overlay the Eastern Corridor upon the acquisition of
right-of-way for the Corridor.
It is important to note that this easement is in lieu of any
other land use restrictions within the Browning Corridor. At
one point, restrictions upon residential uses, size and location
of parks, etc., throughout the Browning Corridor were demanded
by the Marine Corps.

The Ground Control Approach (GCA) will be relocated. The GCA is
used for instrument landing approaches during adverse weather
conditions. The GCA will not affect existing or future
residential areas of Tustin.
The Irvine Company has agreed to convey to the Marine Corps all
or a portion of 39 acres of land south of the helicopter base in
the event an appraisal (now underway) shows that the value of
the road easement is greater than the Browning Corridor and/or
clearance easements.
The conveyance of the road right-of-way to The Irvine Company
will be simultaneously conveyed to the city of Tustin.
The cities and The Irvine Company agree to relocate the heavy
lift training facilities to Camp Pendleton. A site and design
criteria have been agreed upon and are part of the final
agreement.
The Marine Corps has agreed upon design criteria for Myford
Road.
The Marine Corps has agreed to take steps required to remove the
hazardous wastes situated within the road right-of-way. The
California Regional Water Quality Control Board has ordered that
remedial action is required.
If the cities and The Irvine Company wish to advance the time
for remediation of this condition, they may do so by separate
agreement with the Marine Corps. It is contemplated in that
circumstance that the Marine Corps will contribute the costs
which would otherwise be legally required for the remediation
and that the balance of the expense will be shared among the
cities and Company as they may agree.
The agreement is structured to permit construction of the road
by spring, 1987 barring any unforeseen circumstances.
