STATEMENT AND QUESTIONS PRESENTED BY DOREEN JACOBS AT THE TUSTIN
COMMUNITY REDEVELOPMENT AGENCY PUBLIC HEARING ON THE MATTER OF
THE TOWN CENTER AREA REDEVELOPMENT PROJECT DISPOSITION AND
DEVELOPMENT AGREEMENT.
GENTLEPERSONS:
I AM DOREEN JACOBS, OWNER OF THE ELECTRIC EYE VIDEO STORE LOCATED
IN THE NEWFORTH SHOPING CENTER. I WOULD LIKE TO ASK A FEW
QUESTIONS CONCERNING THE DISPOSITION AND DEVELOPMENT AGREEMENT
WHICH IS THE TOPIC OF THIS PUBLIC HEARING.
AS I HAVE SEVERAL QUESTIONS, I WOULD LIKE TO POSE ALL OF THEM AT
ONCE AND THEN SIT DOWN WHILE YOU REPLY. I HAVE A WRITTEN COPY
FOR YOUR CONVENIENCE.
WHO IS LA FAYETTE PARTNERS? ARE THERE ANY LIMITED PARTNERS
OR ARE ANY CONTEMPLATED? IF SO, WHAT RESTRICTIONS HAVE BEEN
IMPOSED ON ANY PARTNERS, ESPECIALLY WITH RESPECT TO POTENTIAL
CONFLICTS OF INTEREST?
2. WHO IS BENTALL PROPERTIES, INC.? SPECIFICALLY, WHO ARE THE
OFFICERS, DIRECTORS AND STOCKHOLDERS?
WHAT STEPS HAS THE CITY ATTORNEY TAKEN IN REVIEWING THE
COMPOSITION OF LA FAYETTE PARTNERS, TO ASSURE THAT NO
CONFLICTS OF INTEREST ARE INVOLVED?
WHY HAS LA FAYETTE PARTNERS BEEN CHOSEN FOR THIS DEVELOPMENT?
HAVE OTHER DEVELOPERS BEEN CONTACTED TO DETERMINE IF A BETTER
DEAL COULD BE MADE? HAS THE PROPOSED DEVELOPMENT, AND
SPECIFICALLY THIS DEVELOPMENT AGREEMENT, BEEN PUT OUT FOR
COMPETITIVE BID? IF NOT, WOULDN'T IT BE IN THE CITY'S
INTEREST TO DO SO?
WHY IS THE AGENCY PROCEEDING ON SUCH AN URGENT BASIS?
WOULDN'T A FEW MORE MONTHS ALLOW THE CITY TO PURSUE BETTER
TERMS AND GIVE THE EXISTING TENANTS OF THE CENTER MORE TIME
TO RELOCATE? (NOTE! THE RELOCATION REPRESENTATIVE OF THE
AGENCY HAS STATED THAT IT WILL BE IMPOSSIBLE FOR THE EXISTING
TENANTS TO MOVE WITHIN THE TIME SCHEDULE THAT THE AGENCY HAS
SET. )

UNDER THE TERMS OF THIS AGREEMENT, THE TUSTIN REDEVELOPMENT
AGENCY WILL SELL THE REAL PROPERTY INVOLVED IN THE
DEVELOPMENT FOR BETWEEN 1.5 AND 2.0 MILLION DOLLARS LESS THAN
WHAT IT WILL COST THEM (INCLUDING FEES, TIME, COSTS OF
GETTING RID OF THE EXISTING TENANTS, PURCHASE OF PROPERTY AND
RIGHTS, ETC.). VARIOUS MEMBERS OF THE CITY STAFF AND CITY
COUNCIL HAVE STATED THAT THIS WILL BE MORE THAN MADE UP BY
THE INCREASED SALES TAXES. WHAT IS THE CITY'S PROJECTION FOR
THE TOTAL RETAIL SALES ANTICIPATED AS A RESULT OF THE
PROPOSED PROJECT? WHAT IS THE INCREASE IN SALES TAXES OVER
THE PROJECTIONS FROM THE EXISTING BUSINESS? HAS AN
INDEPENDENT AUDITOR VERIFIED THESE PROJECTIONS TO JUSTIFY THE
CITY GIVING ALMOST 2 MILLION DOLLARS OF PUBLIC FUNDS TO A
PRIVATE DEVELOPER, ESPECIALLY WITHOUT COMPETITIVE BIDDING?
THE AGENCY STATES THAT THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT HAS BEEN COMPLIED WITH BY THE AGENCY IN ADOPTION OF THE
PROJECT. THE ENVIRONMENTAL IMPACT REPORT ORIGINALLY FILED BY
THE AGENCY AS PART OF THE ORIGINAL ACT DOES NOT INCLUDE THIS
PROJECT SPECIFICALLY, AND DOES NOT INCLUDE ANY EXAMINATION OF
THE EFFECT ON TRAFFIC RESULTING FROM A RETAIL CENTER OF THE
SIZE CONTEMPLATED BY THIS PROJECT. SINCE IT IS POSSIBLE THAT
THE REQUIRED STUDY OF THE EFFECT OF THE PROJECT ON TRAFFIC
WOULD INDICATE THAT A PROJECT HAVING MORE OFFICE SPACE AND
LESS RETAIL SPACE WOULD BE MORE DESIRABLE, SHOULDN'T THE
ENVIRONMENTAL IMPACT REPORT BE PREPARED BEFORE THIS AGREEMENT
IS APPROVED? AND--SINCE THAT RESULT WOULD BE IN CONFLICT
WITH THE AGENCY'S DESIRE, SHOULDN'T THAT STUDY BE PREPARED BY
AN INDEPENDENT GROUP, SO AS TO AVOID A CONFLICT OF INTEREST?
HAS THE CITY CONSIDERED ALTERNATE USES OF THIS PROPERTY, SUCH
AS A PARK, TOWN CENTER, PARKING LOT, HOSPITAL, OR OTHER TYPE
OF DEVELOPMENT? IS. IT FEASIBLE TO CONSTRUCT AN OFFICE SITE
WITH LIMITED RETAIL SPACE? THIS COULD SAVE THE CITY 1.5 TO 2
MILLION DOLLARS, NOT REQUIRE THE INCREASED SALES TAX, AND
RESULT IN MUCH LESS TRAFFIC.
HAS THE CITY EXAMINED THE FUTURE REQUIREMENTS FOR RETAIL
SPACE IN TUSTIN? WHO WOULD BENEFIT IF THE CITY FINANCED A
NEW CENTER WITH PUBLIC FUNDS ONLY TO LEAVE EXISTING SPACE IN
TUSTIN EMPTY AND UNDER FUNDED? IS IT THE CITY'S INTENTION TO
CREATE SOME NEW BLIGHTED AREA THAT IT COULD THAN REDEVELOP?

10. CONSIDERING THE FACT THAT THE AGENCY WILL HAVE APPROXIMATELY
3.5 MILLION DOLLARS TIED UP IN THIS PROJECT, IS A 25 THOUSAND
DOLLAR GOOD FAITH DEPOSIT SUFFICIENT? IT SEEMS THAT 10
PERCENT OR 350 THOUSAND DOLLARS WOULD BE MORE APPROPRIATE.
THIS IS THE AMOUNT THAT IS REQUIRED FOR MOST BONDS.
