ORDINANCE NO. 937 - EXTENSION OF INTERIM URGENCY ORDINANCE FOR
SPECIFIC PLAN AREA NO. 7
DISCUSSION:
The City Council at its meeting on May 20, 1985 unanimously adopted an interim
urgency ordinance requiring development within the area known as Specific Plan
Area No. 7 {Santa Fe/Edinger Specific Plan) to conform with the proposed
Specific Plan as determined by the Planning Commission. Secondly, the interim
urgency ordinance requires the payment or security for payment of Circulation
Improvement Fees pending adoption of the final plan this fall.
While the original Ordinance No. 930 was an urgency measure, it does not
prohibit development but requires its conformity with the contemplated specific
plan and amendment to the South/Central Redevelopment Project Area. However,
since government code section 65858 applies to this interim urgency ordinance,
the ordinance will expire 45 days from its adoption.
At this time staff recommends extension of this interim ordinance for a period
of six months to allow adequate time for completion and processing of Specific
Plan No. 7 by J.L. Webb Planning, consultants to the city.
Pursuant to State law, the following describes measures taken to alleviate the
condition which led to the adoption of the ordinance:
Following adoption of the interim urgency ordinance, Community Development staff
continued its preparation and completion of the South/Central Project Area
amendment for the Redevelopment Agency. This project area plan will provide a
necessary funding mechanism to construct circulation improvements within
Specific Plan Area No. 7 as required to mitigate traffic generated in the area.
The final Specific Plan will incorporate the South/Central EIR as mitigation to
alleviate any adverse impacts which could result from adoption of the specific
plan. At present, the two majority property owners namely the Santa Fe Land
Improvement Company and Pacific Bell Telephone, are participating in both the
preparation of the redevelopment and specific plans. The majority property
owners realize proper planning and design of the circulation system will
ultimately serve and benefit their property. Santa Fe Land Company to date has
funded the specific plan preparation under staff's direction.

Staff recommends the Council introduce, first read and adopt Ordinance No. 937
as an urgency ordinance by a minimum four-fifths vote of the Council.

AN URGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF TUSTIN, CALIFORNIA, REQUIRING
COMPLIANCE WITH PROPOSALS OF A SPECIFIC PLAN
The City Council of the City of Tustin, California, does hereby ordain as
follows:

The City Council finds and determines as follows:

The Planning Commission and City Council presently have under
consi'deration the adoption of a Specific Plan, Amendment to the
South/Central Redevelopment Project, a Circulation Element
amendments and the adoption of a fee schedule .for bridges and
major thoroughfares as authorized by Section 66484.3 of the
Subdivision Map Act for the area located northerly and southerly
of Edinger Street and westerly of Red Hill Avenue as further
depicted by the map shown as Exhibit A, attached hereto and a '
part hereof.
Environmental Impact Reports and traffic studies of the subject
area indicate critical deficiencies in the circulation system
serving the area which cannot be accommodated with the financial
assistance of developing properties within the subject area.
Further developments within the subject area in conflict with
the proposed Specific Plan, Circulation Element Amendment and
Bridge and Major Thoroughfare Contributions would be injurious
to the public safety, health and welfare.
The City Council further finds and determines pursuant to Section
6'5858 of the California Planning and Zoning Law as follows:
A proposed development within the area identified by-Exhibit "A"
shall require a finding by the Planning Commission that the
proposed development is not in conflict with the specific plan
under consideration or proposed amendments to the Circulation
Element.
The issuance of a building permit for subject area shall be
conditioned upon the payment of a Circulation Improvement Fee as
described by Section 66484.3 of the Subdivision Map Act, to
require a fair share contribution of the developer based on type
of use and building area as follows:
Commercial/Office

Industrial
$2.60 per sq.ft, of building floor area
$1.80 per sq.ft, of building floor area
$1.00 per sq.ft, of building floor area

III. The City Council finds and determines that the immediate adoption of
the ordinance as an urgency measure is' necessary to protect and
preserve the public health, safety and welfare and ordains that this
measure shall be effective immediately upon its adoption and extend
for a. period of six {6) months from the date of adoption of this
ordinance, unless duly extended or terminated prior to its
expiration.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the day of , 1985.
