BACKGROUND
After several workshop type sessions and a series of public hearings, the
Planning Commission has recommended to the City Council that land use
regulations governing certain properties on Yorba Street be comprehensively
revised. Specifically, several properties on Yorba, between First Street and
Irvine Boulevard are recommended to be changed from residential to professional
office uses. This change is to be accomplished by the approval of General Plan
Amendment 85-1, Zone Change 85-5, and the implementation of Specific Plan No.
9. The land use study and justifications for the change in land use
designations are included in the attached staff report dated June 10, 1985.
DISCUSSION
To accomplish the actions recommended by the Commission the Council must adopt
Resolution No. 85-65, Ordinance No. 934 and Ordinance No. 935. The specific
results of each action are summarized below:
Resolution No. 85-65 Exhibit A of Resolution No. 85-65 reflects the
amendment of the General Plan Designations for lots 1 through 13. The
precise changes are as follows:
Lot 1: From Public and Institutional (P&I) to Professional Office
Lots 2, 3, 12 and 13: From Multiple Family Residential (MF) to
Professional Office (PR).
Lots 4 through 11: From Single Family Residential (R1) to
Professional Office (PR).
Zone Chan~e 85-5 Exhibit A of Ordinance No. 934 reflects the change in
zone deignations for Lots I through 13 to Professional Office (PR) and Lot
14 to Public and Institutional (P&I). The precise changes are as follows:
Lots 1, 12 & 13: From Multiple Family Residential (R-3) to
Professional Office (PR).

Lot 14: From Multiple Family jResidential (R-3) to Public and
Institiutional (P&I).
The change of Lot 14 is to bring the zoning on the property into conformance
with the current General Plan designation and the existing land use.
Ordinance No. 935 Exhibit A of Ordinance No. 935 illustrates parcels to be
governed by the proposed Specific Plan No. 9. The text of the proposed Plan is
incorporated into Ordinance No. 935.
R£COI~END~D ACTION
It is recommended that the City Council take the following actions as
recommended by the Planning Commission:
1. Approve General Plan Amendment No. 85-1 by the adoption of
Resolution N. 85-65.
Have first reading by the title only, and introduce Ordinance
934 approving Zone Change 85-5.
Have first reading by title only and introduce Ordinance No. 935
approving Specific Plan No. 9.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING GENERAL PLAN
AMENDMENT 85-1, AMENDING THE LAND USE ELEMENT OF
THE TUSTIN AREA GENERAL PLAN FOR CERTAIN PROPERTIES
ON YORBA STREET BETWEEN FIRST STREET AND IRVINE
BOULEVARD AS SHOWN ON EXHIBIT "A" ATTACHED HERETO
The City Council of the City of Tustin does hereby resolve as follows:
The City Council finds and determines as follows:

Section 65358 of the Government Code of the State of California
provides that when it is deemed to be in the public interest,
the legislative body may amend a part of the General Plan.
That in accordance with SectiOn 65358 of the Government Code of
the State of California, a public hearing before the Planning
Commission was duly called, noticed and held on the application
initiated by the city of Tustin to reclassify the General Plan
Land Use designation for the properties indicated on the
attached Exhibit A. Specifically, the following changes are to
be made:
Lot 1: From Public and Institutional to Professional Office
Lots 2, 3, 12 & 13: From Multiple Family Residential to
Professional Office
Lots 4 through 11: From Single Family Residential to
Professional Office

That the Planning Commission did recommend to the City Council
by the adoption of Resolution No. 2238 that General Plan
Amendment 85-1 be approved.
D. That a public hearing before the City Council concerning General
Plan Amendment 85-1 was duly called noticed and held.
That a Negative Declaration has been prepared in accordance with
the requirements of the California Environmental Quality Act and
is hereby approved.
That a change in classification would be in the public interest
and not detrimental to the welfare of the public or the
surrounding property owners.

OF TUSTIN ADOPTING SPECIFIC PLAN NO. 9 REGULATING
DEVELOPMENT ON INCLUDING CERTAIN PROPERTIES ON
YORBA STREET BETWEEN FIRST STREET AND IRVINE BLVD.

The City Council of the City of Tustin does hereby ordain as follows:
I. The City Council hereby finds and determines as follows:

That an action was initiated by the City of Tustin to adopt a
Specific Plan for professional office uses concerning certain
properties on Yorba Street between First Street and Irvine
Blvd. Specific properties are indicated on the attached Exhibit
That a public hearing before the Planning Commisssion was duly
called, noticed and held on said Specific Plan and determined
that the establishment of a specific plan would be in the
interest of the public health, safety, and general welfare for
persons residing or working in the immediate vicinity as
evidenced by the following findings:
Development standards contained in the text of Specific
Plan Regulations have been established to mitigate
potential adverse impacts of development by addressing
lighting, traffic circulation, maximum building heights,
minimum setbacks of structures, and the encouragement of
lot consolidation.
C. That a public hearing before the City Council was duly called,
noticed and held concerning Specific Plan No. 9.
That a Negative Declaration has been prepared in accordance with
the requirements of the California Environmental Ouality Act and
is hereby approved.

E. That the City Council hereby concurs with the findings of the
Planning Commission as contained in Resolution No. 2240.
II.
The City Council does hereby approve Specific Plan No. 9 for the
properties shown on Exhibit "A" attached hereto subject to the
following condition:

I. OBJECTIVES
Ae
Preserve and protect the public health, safety, and general
welfare of the area by encouraging the orderly development of the
subject property.
Be
Plan for a consistent neighborhood development which conforms
with the General Plan for the City of Tustin and goals of the
community.
Ce
Develop standards that will be uniformly applied to all lots
within the specific plan area, regardless of ownership.
The active encouragement of lot consolidation within the specific
plan area.
Reduction in the number of curb-cuts and drive aprons currently
providing ingress and egress onto Yorba Street.
II. STATISTICAL DATA
The specific plan shall include the parcels indicated on the attached
exhibit, and consists of a total area of approximately 2.52 acres.
III. NOTES/PEMITTED USES
Ae
Within the specific plan area, conversion of existing structures
and/or the construction of new buildings shall be limited
to professional office uses.
Be
The continued use of existing structures as single family
dwellings, as defined in Tustin City Code Section 9223(a)1. shall
be permitted.
Ce
No building permits shall be allowed for any project which does
not conform to the general development standards of this plan.

Where conflicts between these general development standards and
other zoning regulations exist, the provisions of the specific
plan shall prevail.
Within the specific plan area, water services will be provided by
Tustin Water Works, sewerage facilities by the County Sanitation
District No. 7, electrical services by Southern California

Edison, and gas services by Southern Caiifornia Gas. Drainage
plans shall be reviewed by the Building Official and conform to
the requirements of the Orange County Flood Control District.
IV. DEFINITIONS

Where applicable definitions in Tustin City Code Section 9297
shall be incorporated into this specific plan by reference.
Professional Office uses shall be defined as including, but not
being limited to the following.
1. Professional offices for: architect, attorney,
chiropractor, dentist, doctor, oculist, optometrist,
and others licensed by the State of California to practice
the healing arts, including clinics for outpatients only,
laboratories for x-ray and diagnostic purposes, as
generally associated with any of the above; engineer, land
surveyor, land planner and accountant.
2. General offices for: building consultants,draftsmen and
economic consultants.
3. Accessory structures, buildings and uses normally
incidental to any of the above listed commercial uses
except that no building site may beused simultaneously for
residential and professional purposes.
4. Home occupations in accordance with this chapter. (Ord.
5. Personnel agency.
6. Answering service.
7. Collection agency.
8. Insurance agency.
9. Land and property management.
10. Contractors business office.
11. Advertising agency.
12. Photographer.
13. Interior decorator or artist studio.
14. Management, technicalor professional consultant.
15. Stock broker.

18. Title insurance company
19. Dispensing pharmacy, selling only drugs, medicines and
health aid.
20. Other uses in the opinion of the Planning Commission are
similar in nature to listed uses.

V. GENERAL DEVELOPMENT STANDARDS
To meet the objective of lot consolidation outlined in this plan two sets
of development standards shall be in effect:
Small Lot Development - The following criteria shall apply to any
single parcel with a street frontage less than 100 linear feet
and/or a gross land area less than 6,000 square feet.

Maximum height: One story, no higher than 20 feet.
Minimum front yard setback: 20 feet
Minimum side yard setback: 5 feet
Minimum rear yard setbck: 15 feet
Parking:
a) Professional Office: one space for each 250 gross
square feet of building area
b) Medical Office: six spaces for each 1,000 gross
square feet of building area.
c) Percent of Compact parking spaces allowed: 20%

Maximum Lot Coverage: 100% less parking, set back and
landscape requirements.
Large Lot Development - The following criteria shall apply to any
single parcel with a street frontage in excess of, or equal to
100 linear feet,and/or a gross land area in excess of 6,000
square feet.

VI. GENERAL REGULATIONS
Dedication of land and construction of public improvements as
required by the Tustin City Code must be achieved prior to
occupancy of any structure inthe Specific Plan area.
Improvements include, but are not limited to:
Construction or replacement of all missing or damaged
street improvements such as curbs and gutters, sidewalks,
drive aprons, street pavement, street trees and street
lights.
Compliance with the general development and landscape standards
as adopted by the City Council is required unless otherwise
specifically stated within the specifc plan.
Elevations of any proposed structure shall reflect a style
compatible with the surrounding area. The use of earthtone
colors and materials such as brick, wood, and stucco shall be
required. Reflective glass and curtain wall type structures
shall be prohibited.
All final site plans, elevations, colors and materials shall be
reviewed and approved by the Director of Community Development
prior to the issuance of building permits.
Prior to the issuance of building permits a detailed exterior
lighting plan shall be submitted indicating, but not limited to
the following:
1. Location, intensity and orientation of parking lot
lighting;
2. Location, intensity and orientation of security lighting;
3. Mechanisms provided to ensure that lighting does not
adversely impact abutting residential properties.
E. A parcel map shall be filed in conjunction with any lot
consolidation within the Specific Plan area.

Any single project will be permitted only one (1) ingress-egress
access point. Where possible, the mutual use of access points
between adjacent projects will be encouraged.
VII. STATEMENT OF RELATIONSHIP OF SPECIFIC PLAN NUMBER 9 TO THE TUSTIN AREA
GENERAL PLAN.
By the adoption of this plan, the development permitted upon the properties
within the project area will be consistent with all elements of the Tustin Area
General Plan.
