ASSESS DIST 07-01-85A E" Ikl A co, sEN CA,EN . .-~' NO. 5 DATE: JUNE 20, 1985 TO: WILLIAM HUSTON, CITY MANAGER FROM: BOB LEDENDECKER, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: EAST TUSTIN ASSESSMENT DISTRICT NO. 85-1 RECOMMENDATION: That the Tustin City Council, at their meeting of July 1, 1985, pass and adopt the attached Resolution which designates persons to perform various duties for special assessment proceedings. BACKGROUND: In May, 1985, the City Council accepted a petition filed by The Irvine Con~)any for the formation of the East Tustin Assessment District No. 85-1. Certain firms and/or individuals are required to perform various duties for special Assessment District proceedings in accordance with the provisions of the law. DISCUSSION: The attached Resolution designates the following: 1. That Robert S. Ledendecker is hereby appointed to perform all duties and functions of the Superintendent of streets. 2. The office of the Superintendent of streets shall be the place where the assessment roll and diagram is maintained as a permanent record. 3. That the Tusti.n News is designated as the newspaper for all publications related to the Assessment District. 4. Witldan Associateslis designated as the Assessment Engineer. 5. Mudge Rose Guthrie and Alexander is designated as Bond Counsel. 6. The establishment of a special fund by name and number of the Assessment District for all financial transactions related to the District. Bob Ledendecker Director of Public Works/City Engineer BL:jr 1 2 4 5 6 7 8 9 10 11 12 13 14 15 17 18 20 21 9.2 23 2~ 25 2~ 27 28 RESOLUTION NO. 85-69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING PERSONS TO PERFORM VARIOUS DUTIES FOR SPECIAL ASSESSMENT PROCEEDINGS WHEREAS, the City Council of the City of Tustin, California, is considering the formation of a special Assessment District, pursuant of the terms and provisions of the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California, for the construction of certain public works of improvement, together with appurtenances and appurtenant work, said special Assessment District to be known and designated as ASSESSMENT DISTRICT NO. 85-1 (hereinafter referred to as the "Assessment District"): and, WHEREAS, at this time, the City is desirous of making the required appointments and designating persons to perform certain duties, in order to allow the proceedings to go forward to completion in accordance with the provisions of law: and, WHEREAS, the City has now received all property owner Agreements relating to the initiation of proceedings and the establishment of jurisdiction in this City Council. SECTION 1. SECTION 2. SECTION 3. SECTION 4. SECTION 5. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: That the above reCitals are all true and correct. That Robert S. Ledendecker is hereby appointed to perform all of the duties and functions of the Superintendent of Streets as said duties are specified and designated in the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California, for the above referenced Assessment District. That the place for recordation of the assessment roll and diagram shall be in the Office of the Superintendent of Streets, and said assessment roll and diagram, upon recordation, shall be kept as a permanent record. That the Tustin News is hereby designated as the newspaper for all publications as required by law and as necessary for completion of this Assessment District. That Willdan Associates is hereby appointed the ASSESSMENT ENGINEER for said proceedings, and said Assessment Engineer shall perform all of the duties and responsibilities as set forth by law as they relate to said Assessment District. 1 2 3 4 5 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 21 25 26 27 28 SECTION 6. SECTION 7. That Mudge, Rose, Guthrie and Alexander Attorney at Law, is hereby appointed to act as Bond Counsel for the purposes of preparing proceedings and issuing an approving opinion attesting to the validity of the proceedings and the enforceability of the bonds. That this City Council hereby establishes a special fund designated by the name and number of the Assessment District, and into said fund shall be placed all proceeds from the sale of bonds and cash collections. In order to expedite the improvements or acquisition under these proceedings and as authorized by law, funds from any available source may be transferred into said special fund. Any funds transferred are a loan to the fund and shall be repaid out of the proceeds of the sale of bonds, all as required and authorized by law, and specifically Section 10210 of the Streets and Highways Code of the State of California. 1985.
