OF THE CALIFORNIA ENVIROIOIENTAL QUALITY ACT, CLASS 15.
SUBDIVIDE 2 LOTS INTO 3 LOTS.
BACKGROUND AND DISCUSSION:
In August of 1984, Birtcher Pacific II obtained building permits for three
research and development buildings with a free-standing parking structure on
these two existing parcels. The property owner is now requesting authorization
to split these two existing parcels of 6.16 acres into three parcels:
Parcel #1 - 2.06 acres
Parcel #2 - 1.96 acres
Parcel #3 - 2.14 acres
Attached to this report is a request for a waiver for separate sewer
connection. The building on Parcel 1 is presently being served by an individual
sewer line independent of the other building's sewer lines, however it does
cross Parcel 2 to gain access to a sewer lateral in Bell Avenue.
Because of the configuration of the development on these properties, covenants,
conditions and restrictions shall be recorded providing for reciprocal
ingress/egress, parking and maintenance of common drives, landscaping etc. which
will be reviewed by the City Attorney.
All parcels comply with the Tustin Area General Plan, the City of Tustin Zoning
Ordinance along with the Irvine Planned Community Regulations for this area.

On June 24, 1985 the Planning Commission recommended approval of Tentative
Parcel Map 85-212 by the adoption of Resolution No. 2247.
RECOHHENDED ACTION:
Staff recommends approval of Tentative Parcel Map No. 85-212 by the adoption of
Resolution No. 85-63.

WAIVER REQUEST FOR SEPARATE SEWER/TENTATIVE
PARCEL MAP NO. 85-212; OUR JOB NO. 83265
This letter is written on behalf of our clients, Birteher Campbell Properties, the
owner, subdivider and developer of property referenced in the above tentative
parcel map. Birtcher Campbell was issued building permits and began
construction of the Northpointe project several months ago. The property, as it
presently exists, consists of two legal parcels. Tentative Parcel Map 85-212
would put each building on a separate parcel except for the parking structure.
The project by design will require Covenants, Conditions and Restrictions for
reciprocal ingress/egress, parking and maintenance of common drives, and
landscaping. In addition, easements will be provided in the CC&R's for all utility
services including sanitary sewer, domestic water, fire service, electricity and
telephone. The building on Parcel 1 is presently being served by an individual
sewer line independent of the other building% sewer lines, however does cross
Parcel 2 to gain access to a sewer lateral in Bell Avenue. This was done because
the City would not permit access to the trunk sewer in Red Hill Avenue due to
location of other utilities. In addition, the elevation of the trunk sewer in Red
Hill would not permit connection for the property. This separate sewer line will
be adequately covered in the CC&R's with an easement for installation and
maintenance.
We respectfully request a waiver from the City provisions requiring each sewer
line to be completely on each parcel.

RESOLUTION NO. 85-63
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
APPROVING TENTATIVE PARCEL MAP 85-212 LOCATED AT NORTHWESTERLY
CORNER OF RED HILL AVENUE AT BELL AVENUE.
The City Council of the City of Tustin does hereby resolve as follows:
· The City Council finds and determines as follows:

That Tentative Parcel Map No. 85-212 was submitted to the
City Council pursuant to Ordinance No. 847 by Williamson and
Schmidt on behalf of Birtcher Campbell Properties for the
purpose of subdividing two lots into three lots for the property
known as a portion of Lot One Tract 7721 per map filed in Book
347, pages 35 and 36 of Miscellaneous Maps; together with Parcel
Two of Parcel Map No. 76-84 per map filed in Book 86, page 36 of
Parcel Maps; Records of Orange County.
That said map is in conformance with the Tustin Area General
Plan.

That this project is categorically exempt from the requirements
of the California Environmental Quality Act.
The City Council hereby approves Tentative Parcel Map No. 85-212
subject to the following conditions:
1. Separate domestic water services shall be provided to each
parcel.
CC & R's shall be recorded providing for reciprocal
ingress/egress, parking and maintenance of common drives and
landscaping.
3. Easements for utility purposes shall be provided between each
parcel to include but not be limited to:
a. Sanitary sewer service
b. Domestic water service
c. Fire service
d. Edison and telephone

Drainage easements shall be provided between each parcel as
needed.

Construction or replacement of any missing or damaged street
improvements adjacent to this Parcel Map will be required.
