Recommend the Tustin City Council, at their regular meeting of July 1, 1985 :
approve the Engineers Report as a preliminary document; pass and adopt the
Resolution of Intention to formulate the Tustin Landscape and Lighting District;
and, set July 15, 1985 as the date for the public hearing to discuss the District.
BACKGROUND:
On May 6, 1985, Council adopted Resolution 85-43 for the initiation of the Tustin
Landscape and Lighting District pursuant to the Landscape and Lighting Act of
1972. At the same time, Council directed staff to engage a consultant to prepare
the Engineers Report and perform all subsequent work as required to formulate and
implement the District.
Staff solicited proposals from six (6) consulting firms. Two proposals were
submitted: 1) Jay Kim Engineers, Inc. of Brea, $10,240.00; Berryman and
Stevenson, Inc. of Santa Ana, $1,600.00. Berryman and Stevenson, Inc. was
selected to prepare the Engineers Report and perform subsequent work as required
to formulate and implement the District.
It is recommended that Council approve the attached Engineers Report as a
preliminary document as Council may desire to amend "the Report" after the public
hearing. In accordance with the Landscape and Lighting Act of 1972, the next
action Council needs to take is to pass and adopt the Resolution of Intention to
formulate the Tustin Landscape and Lighting District; and, the final Council
action, at this time, is to set a date for the public hearing to discuss the
District.
Staff recommends Council pass and adopt the Resolution of Intention and set the
date of July 15, 1985 so that the confirmed assessment roll can be filed with the
County Auditor-Controller by the deadline of August 12, 1985. Berryman and
Stevenson, Inc. will prepare for mailing the notices of the public he~aring to the
property owners; the City Clerk will need to place the notice of public hearing in
the newspaper.

RESOLUTION NO. 85-72
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE FORMATION
OF TUSTIN LANDSCAPING AND LIGHTING DISTRICT AND TO LEVY
AND COLLECT ASSESSMENTS PURSUANT TO THE LANDSCAPING AND
LIGHTING ACT OF 1972
WHEREAS, the City Council of the City of Tustin, California,
has adopted Resolution No. 85-43, initiating proceedings for the formation of
an Assessment District pursuant to the Landscape and Lighting Act of 1972 for
the maintenance and operation of street lighting and landscaping; and
WHEREAS, the Engineer has prepared and filed with the City
Clerk his report containing the matters specified in Section 22567 of the
Streets and Highways Code of the State of California; and
WHEREAS, the public interest and welfare require the
maintenance and operation of street lighting and landscaping located within the
proposed Assessment District which has been designated "Tustin Landscape and
Lighting District".
NOW THEREFORE, the City Council of the City of Tustin does
hereby resolve as follows:
SECTION 1: The foregoing recitals are true and correct and
the City Council so finds and determines.
SECTION 2: The City Council hereby declares its intention to
order the formation of an Assessment District designated "Tustin Landscape and
Lighting District" the boundaries of which are generally described in Section
4, hereto, and to levy and collect assessments pursuant to Part 2 of Division
15 of the Street and Highway Code.
SECTION 3: The improvements to be undertaken in the proposed
Assessment District are the maintenance and operation of street lighting and
landscaping.
SECTION 4: The proposed Assessment District generally
encompasses all of the territories within the boundaries of Browning Avenue,
Irvine Boulevard, Myford Road, and I-5 Freeway, within the City of Tustin
including property owned by railroad and public utility companies.
SECTION 5: Reference is hereby made to the Report of the
Engineer on file with the City Clerk for a full and detailed descrption of the
improvements, the boundaries of the proposed Assessment District and any zones
therein, and the proposed assessments upon assessable lots and parcels of land
within the District.
SECTION 6: Notice is hereby given that Monday, July 15, 1985,
at the hour of 7:00 p.m. in the City Council Chambers, 300 Centennial Way,
Tustin, California 92680, are hereby fixed as the time and place for a hearing
by the City Council on the question of the formation of the Assessment District
and levying of the proposed assessment.

SECTION 7: The City Clerk is hereby directed to give notice
of the hearing referred to in Section 6 by causing this Resolution
of Intention to be published and mailed as required by Section
22556 of the Street and Highway Code.
The foregoing Resolution was passed and adopted at at regular
meeting of the Tustin City Council held on , 1985.
